91_SB1078 LRB9101296ACtmA 1 AN ACT to amend the Radiation Protection Act of 1990 by 2 changing Sections 14 and 15. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Radiation Protection Act of 1990 is 6 amended by changing Sections 14 and 15 as follows: 7 (420 ILCS 40/14) (from Ch. 111 1/2, par. 210-14) 8 Sec. 14. Radiation Protection Advisory Council. There 9 shall be created a Radiation Protection Advisory Council 10 consisting of 7 members to be appointed by the Governor on 11 the basis of demonstrated interest in and capacity to further 12 the purposes of this Act and who shall broadly reflect the 13 varied interests in and aspects of atomic energy and ionizing 14 radiation within the State. The Director of the Department of 15 Labor and the Chairman of the Commerce Commission or their 16 representatives shall be ex-officio members of the Council. 17 Each memberMembersof the Council shall be appointed for 18 a 4 year term and shall continue to serve until a successor 19 is appointedterms, except that, of the initial members the20terms of 2 shall expire at the end of the first year, 2 at21the end of the second year, and 3 at the end of the third22year. Any member appointed to fill a vacancy occurring prior 23 to the expiration of the term for which his or her 24 predecessor was appointed shall continue to serve until a 25 successor is appointedbe appointed for the remainder of such26term. The Chairman of the Council shall be selected by and 27 from the Council membership. The Council members shall serve 28 without compensation but shall be reimbursed for their actual 29 expenses incurred in line of duty. The Council shall meet as 30 often as the Chairman deems necessary, but upon request of 4 31 or more members it shall be the duty of the Chairman to call -2- LRB9101296ACtmA 1 a meeting of the Council. 2 It shall be the duty of the Council to assist in the 3 formulation of and to review the policies and program of the 4 Department as developed under authority of this Act and to 5 make recommendations thereon and to provide the Department 6 with such technical advice and assistance as may be 7 requested. The Council may employ such professional, 8 technical, clerical and other assistants, without regard to 9 the civil service laws or the "Personnel Code" of this State, 10 as it deems necessary to carry out its duties. 11 Individuals who serve on advisory boards of the 12 Department of Nuclear Safety shall be defended by the 13 Attorney General and indemnified for all actions alleging a 14 violation of any duty arising within the scope of their 15 service on such board. Nothing contained herein shall be 16 deemed to afford defense or indemnification for any willful 17 or wanton violation of law. Such defense and indemnification 18 shall be afforded in accordance with the terms and provisions 19 of the State Employee Indemnification Act"An Act to provide20for representation and indemnification in certain civil law21suits", approved December 3, 1977. 22 (Source: P.A. 86-1341.) 23 (420 ILCS 40/15) (from Ch. 111 1/2, par. 210-15) 24 Sec. 15. Radiologic Technologist Accreditation Advisory 25 Board. 26 (a) There shall be created a Radiologic Technologist 27 Accreditation Advisory Board consisting of 13 members to be 28 appointed by the Governor on the basis of demonstrated 29 interest in and capacity to further the purposes of this Act: 30 one physician licensed to practice medicine in all its 31 branches specializing in nuclear medicine; one physician 32 licensed to practice medicine in all its branches 33 specializing in diagnostic radiology; one physician licensed -3- LRB9101296ACtmA 1 to practice medicine in all its branches specializing in 2 therapeutic radiology; 3 physicians licensed to practice 3 medicine in all its branches who do not specialize in 4 radiology; one medical radiation physicist; one radiologic 5 technologist (radiography); one radiologic technologist 6 (nuclear medicine); one radiologic technologist (therapy); 7 one chiropractor; one person accredited by the Department to 8 perform a limited scope of diagnostic radiography procedures; 9 and one registered nurse. The Director of the Department of 10 Nuclear Safety or his representative shall be an ex officio 11 member of the Board with voting privileges in case of a tie. 12 The Board may appoint consultants to assist in administering 13 this Act. 14 (b) Any person serving on the Board who is a 15 practitioner of a profession or occupation required to be 16 accredited pursuant to this Act, shall be the holder of an 17 appropriate accreditation issued by the State, except in the 18 case of the initial Board members. 19 (c) Each memberMembersof the Board shall be appointed 20 for a 3 year term and shall continue to serve until a 21 successor is appointedterms, except that of the initial22members, the terms of 5 shall expire at the end of the first23year, 5 at the end of the second year, and 3 at the end of24the third year. Any member appointed to fill a vacancy 25 occurring prior to the expiration of the term for which his 26 or her predecessor was appointed shall continue to serve 27 until a successor is appointedbe appointed for the remainder28of such term. No more than 2 successive terms shall be 29 served by a Board member. 30 (d) The Chairman of the Board shall be selected by and 31 from the Board membership. 32 (e) The Board members shall serve without compensation 33 but shall be reimbursed for their actual expenses incurred in 34 line of duty. -4- LRB9101296ACtmA 1 (f) All members of the Board shall be legal residents of 2 the State and shall have practiced for a minimum period of 2 3 years immediately preceding appointment. 4 (g) The Board shall meet as often as the Chairman deems 5 necessary, but upon request of 7 or more members it shall be 6 the duty of the Chairman to call a meeting of the Board.at7least once a year, and at other times on the call of the8Chairman or by a majority of the Board membership.9 (h) The Board shall advise, consult with and make 10 recommendations to the Department with respect to 11 accreditation requirements to be promulgated by the 12 Department; however, the actions of the Board shall be 13 advisory only with respect to the Department. 14 (i) Individuals who serve on advisory boards of the 15 Department of Nuclear Safety shall be defended by the 16 Attorney General and indemnified for all actions alleging a 17 violation of any duty arising within the scope of their 18 service on such advisory board. Nothing contained herein 19 shall be deemed to afford defense or indemnification for any 20 willful or wanton violation of law. Effective date. This Act takes effect upon 27 becoming law.
