91_SB1077enr SB1077 Enrolled LRB9106066SMdv 1 AN ACT to amend the Illinois Public Aid Code by changing 2 Section 12-13.05. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Public Aid Code is amended by 6 changing Section 12-13.05 as follows: 7 (305 ILCS 5/12-13.05) 8 Sec. 12-13.05. Emergency rules to implement amendatory 9 changes. The Illinois Department may implement the 10 amendatory changes to this Code made by this amendatory Act 11 of 1997 and any other changes made as the result of 12 implementing the Temporary Assistance to Needy Families 13 Program under the Personal Responsibility and Work 14 Opportunity Reconciliation Act of 1996 (P.L. 104-193) through 15 the use of emergency rules in accordance with the provisions 16 of Section 5-45 of the Illinois Administrative Procedure Act. 17 For purposes of the Illinois Administrative Procedure Act, 18 the adoption of rules to implement these changes shall be 19 deemed an emergency and necessary for the public interest, 20 safety, and welfare. The emergency rulemaking powers 21 authorized in this Section apply only to rules filed to 22 implement the TANF plan effective July 1, 1997. 23 All rules regulating the Temporary Assistance for Needy 24 Families program and all other rules regulating the 25 amendatory changes to this Code made by this amendatory Act 26 of 1997 shall be promulgated pursuant to this Section. All 27 rules regulating the Temporary Assistance for Needy Families 28 program and all other rules regulating the amendatory changes 29 to this Code made by this amendatory Act of 1997 are repealed 30 on January 1, 2003June 1, 1999. On and after January 1, 2003 31June 1, 1999, the Illinois Department may not promulgate any SB1077 Enrolled -2- LRB9106066SMdv 1 rules regulating the Temporary Assistance for Needy Families 2 program or regulating the amendatory changes to this Code 3 made by this amendatory Act of 1997. 4 (Source: P.A. 90-17, eff. 7-1-97.) 5 Section 99.
