91_SB1056 LRB9103562JSpc 1 AN ACT to create the Utility Environmental Initiative 2 Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 1. Short title. This Act may be cited as the 6 Utility Environmental Initiative Act. 7 Section 5. Findings. The General Assembly finds that the 8 residents of the northern portion of Illinois will continue 9 to enjoy electric utility service at reduced and competitive 10 rates under a deregulated power marketplace. The General 11 Assembly further finds that, along with these deregulated and 12 competitive rates, the environment enjoyed by these power 13 customer should be further enhanced by environmental 14 initiatives of utilities providing the majority of the 15 electrical power in the region. 16 Section 10. Definitions. In this Act: 17 "Commission" means the Illinois Commerce Commission. 18 "Utility" means an electric utility that in the previous 19 calendar year has supplied electric power to over 1,000,000 20 residents. 21 Section 15. Electric utility environmental assistance. 22 (a) Beginning in year 2000, a utility shall annually 23 spend at least $3,000,000 toward projects that will benefit 24 the environment and promote the efficient use of energy. 25 (b) The utility shall file with the Commission and make 26 available to the public by December 1 of 2000 and each year 27 thereafter, a written spending plan detailing what 28 environmental initiatives were funded in that year and the 29 amount expended on those initiatives. These initiatives may -2- LRB9103562JSpc 1 include residential customer energy efficiency programs. 2 Section 20. Expenditures supplemental. The expenditures 3 required under this Act are in addition to any amounts 4 required to be spent by the utility on renewable energy 5 resources programs under Section 6-6 of the Renewable Energy, 6 Energy Efficiency, and Coal Resources Development Law of 7 1997. 8 Section 90. Repealer. This Act is repealed on January 9 1, 2010. 10 Section 99. Effective date. This Act takes effect upon 11 becoming law.
