91_SB1051 LRB9105904EGfg 1 AN ACT to amend the Illinois Pension Code and the State 2 Mandates Act. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pension Code is amended by 6 changing Section 8-230.1 as follows: 7 (40 ILCS 5/8-230.1) (from Ch. 108 1/2, par. 8-230.1) 8 Sec. 8-230.1. Right of employees to contribute for 9 certain other service. Any employee in the service, after 10 having made contributions covering a period of 10 or more 11 years to the annuity and benefit fund herein provided for, 12 may elect to pay for and receive credit for all annuity 13 purposes for service theretofore rendered by the employee to 14 the Chicago Transit Authority created by the Metropolitan 15 Transit Authority Act or its predecessor public utilities; 16 provided that the last 5 years of service prior to retirement 17 on annuity shall have been as an employee of the City and a 18 contributor to this Fund. Such service credit may be paid 19 for and granted on the same basis and conditions as are 20 applicable in the case of employees who make payment for past 21 service under the provisions of Section 8-230, but on the 22 assumption that the employee's salary throughout all of his 23 or her service with the Authority or its predecessor public 24 utilities was at the rate of the employee's salary at the 25 date of his or her entrance into the service as a municipal 26 employee. In no event, however, shall such service be 27 credited if the employee has not forfeited and relinquished 28 pension credit for service covering such period under any 29 pension or retirement plan applicable to the Authority or its 30 predecessor public utilities and instituted and maintained by 31 the Authority or its predecessor public utilities for the -2- LRB9105904EGfg 1 benefit of its employees. 2 If the application to establish credit under this Section 3 is received by the Fund on or after the effective date of 4 this amendatory Act of the 91st General Assembly and before 5 July 1, 2000, no contribution from the employee is required 6 to establish credit for service rendered by the employee to 7 the Chicago Transit Authority during the period July 1, 1974 8 through August 31, 1978. This amendatory Act does not 9 entitle any person to a refund of contributions already paid 10 for credit previously established under this Section. 11 (Source: P.A. 90-655, eff. 7-30-98.) 12 Section 90. The State Mandates Act is amended by adding 13 Section 8.23 as follows: 14 (30 ILCS 805/8.23 new) 15 Sec. 8.23. Exempt mandate. Notwithstanding Sections 6 16 and 8 of this Act, no reimbursement by the State is required 17 for the implementation of any mandate created by this 18 amendatory Act of the 91st General Assembly. 19 Section 99. Effective date. This Act takes effect upon 20 becoming law.
