Amend Senate Bill 1007 as follows: 3 by replacing the title of the bill with the following: 4 "AN ACT in relation to public and private employment."; 5 and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 1. Short title. This Act may be cited as the 9 Broadcasting Industry Freedom of Employment Act. 10 Section 5. Covenants not to compete void. 11 (a) Any contract or agreement that creates or establishes 12 the terms of employment for an employee or individual in the 13 broadcasting industry, including employment with a television 14 station, television network, radio station, radio network, or 15 any entity affiliated with any of the foregoing, and that 16 restricts the right of such an employee or individual to 17 obtain employment in a specified geographic area for a 18 specified period of time after termination of employment of 19 the employee by the employer, or by termination of the 20 employment relationship by mutual agreement of the employer -2- LRB9105626DJcdam 1 and the employee, or by termination of the employment 2 relationship by the expiration of the contract or agreement, 3 is void and unenforceable with respect to that provision. 4 (b) An employee or individual who is adversely affected 5 by a violation of this Act may commence a civil action to 6 enforce his or her rights under this Act. Whoever violates 7 this Act is liable for reasonable attorney's fees and costs 8 associated with litigation by an affected employee or 9 individual in such a civil action. 10 Section 99. Effective date. This Act takes effect upon 11 becoming law.".
