91_SB0966 LRB9106105KSmg 1 AN ACT to amend the Illinois Vehicle Code by changing 2 Section 11-1006. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Vehicle Code is amended by 6 changing Section 11-1006 as follows: 7 (625 ILCS 5/11-1006) (from Ch. 95 1/2, par. 11-1006) 8 Sec. 11-1006. Pedestrians soliciting rides or business. 9 (a) No person shall stand in a roadway for the purpose 10 of soliciting a ride from the driver of any vehicle. 11 (b) No person shall stand on a highway for the purpose 12 of soliciting employment or business from the occupant of any 13 vehicle. 14 (c) No person shall stand on a highway for the purpose 15 of soliciting contributions from the occupant of any vehicle 16 except within a municipality when expressly permitted by 17 municipal ordinance. The local municipality, city, village, 18 or other local governmental entity in which the solicitation 19 takes place shall determine by ordinance where and when 20 solicitations may take place based on the safety of the 21 solicitors and the safety of motorists. The decision shall 22 also take into account the orderly flow of traffic and may 23 not allow interference with the operation of official traffic 24 control devices. Unless otherwise provided by municipal 25 ordinance, the soliciting agency shall be: 26 1. registered with the Attorney General as a 27 charitable organization as provided by "An Act to 28 regulate solicitation and collection of funds for 29 charitable purposes, providing for violations thereof, 30 and making an appropriation therefor", approved July 26, 31 1963, as amended; and -2- LRB9106105KSmg 1 2. engaged in a Statewide fund raising activity.;2and3 3. (Blank).liable for any injuries to any person4or property during the solicitation which is causally5related to an act of ordinary negligence of the6soliciting agent.7 The soliciting agency is liable for any injuries to any 8 person or property during the solicitation that is causally 9 related to an act of ordinary negligence of the soliciting 10 agent. 11 Any person engaged in the act of solicitation shall be 16 12 years of age or more and shall be wearing a high visibility 13 vest. 14 (d) No person shall stand on or in the proximity of a 15 highway for the purpose of soliciting the watching or 16 guarding of any vehicle while parked or about to be parked on 17 a highway. 18 (e) Every person who is convicted of a violation of this 19 Section shall be guilty of a Class A misdemeanor. 20 (Source: P.A. 88-589, eff. 8-14-94.)
