91_SB0942 LRB9105728RCpr 1 AN ACT to amend the Criminal Code of 1961 by changing 2 Section 24-3.3. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 changing Section 24-3.3 as follows: 7 (720 ILCS 5/24-3.3) (from Ch. 38, par. 24-3.3) 8 Sec. 24-3.3. Unlawful sale or delivery of firearms in 9 certain placeson the premises of any school, regardless of10the time of day or the time of year, or any conveyance owned,11leased or contracted by a school to transport students to or12from school or a school related activity, or residential13property owned, operated and managed by a public housing14agency. 15 (a) Any person 18 years of age or older who sells, gives 16 or delivers any firearm to any person under 18 years of age 17 in anyschool, regardless of the time of day or the time of18year orresidential property owned, operated and managed by a 19 public housing agency or on the real property comprising any 20school, regardless of the time of day or the time of year or21residential property owned, operated and managed by a public 22 housing agency commits a Class 3 felony. 23 (b) Any person who sells, gives, or delivers any firearm 24 in any school, regardless of the time of day or the time of 25 year, on the real property comprising any school, regardless 26 of the time of day or the time of year, or any conveyance 27 owned, leased, or contracted by a school to transport 28 students to or from school or a school related activity, 29 regardless of the time of day or the time of year, or within 30 1,000 feet of a school commits a Class 3 felony. School is 31 defined, for the purposes of this Section, as any public or -2- LRB9105728RCpr 1 private elementary or secondary school, community college, 2 college or university. This subsection (b) does not apply to 3 peace officers or to students carrying or possessing firearms 4 for use in school training courses, parades, target shooting 5 on school ranges, or otherwise with the consent of school 6 authorities and which firearms are transported unloaded and 7 enclosed in a suitable case, box or transportation package. 8 (Source: P.A. 86-946; 87-524.)
