91_SB0919 LRB9101964MWpcA 1 AN ACT concerning abolition of tuberculosis sanitarium 2 boards, amending named Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Counties Code is amended by changing 6 Section 5-23002 as follows: 7 (55 ILCS 5/5-23002) (from Ch. 34, par. 5-23002) 8 Sec. 5-23002. Abolishment of board of directors. The 9 county board of each county which has appointed a board 10 pursuant to this Division may, by resolution abolish such 11 board. The county board by resolution may abolish its 12 tuberculosis sanitarium board upon joint request of the 13 county health department and the tuberculosis sanitarium 14 board. 15 A county board's resolution must also provideprovided16such resolution also providesthat: 17 (a) in counties which have established a county or 18 multiple-county health department in accordance with Division 19 5-25 or its predecessor and have an existing Board of 20 Health: 21 (1) The membership of the Board of Health in single 22 counties be increased to 11 in counties where present 23 membership is 8 and to 15 in counties where present 24 membership is 12, a majority of which shall be members of 25 the general public, and 26 (2) The employees, records, assets and liabilities 27 of the board be transferred and assumed by the Board of 28 Health, and 29 (3) (i) An additional tax be imposed by the county 30 board at a rate, which shall not be increased at any 31 time, which is equal to the greater of (A) the -2- LRB9101964MWpcA 1 average tax rate imposed in the county pursuant to 2 this Division over the most recent 5 year period, or 3 (B) the rate that would have been necessary to raise 4 the average amount that has been spent annually for 5 the most recent 5 year period regardless of whether 6 a tax was levied under this Division during such 5 7 year period; or 8 (ii) A tax be imposed by the county board up 9 to the maximum rate that had been authorized to be 10 imposed by a referendum approved under this 11 Division; or 12 (b) in counties which have not established a county or 13 multiple-county health department in accordance with Division 14 5-25 or its predecessor and do not have an existing Board of 15 Health: 16 (1) a county or multiple-county health department 17 be established and a Board of Health be appointed 18 pursuant to Division 5-25, 19 (2) the employees, records, assets and liabilities 20 of the board be transferred and assumed by the newly 21 created Board of Health, and 22 (3) A tax be imposed by the county board up to the 23 maximum rate which had been authorized to be imposed by a 24 referendum approved under this Division. 25 (Source: P.A. 86-962; 86-1475.) 26 Section 99. Effective date. This Act takes effect upon 27 becoming law.
