91_SB0866 LRB9101506MWgcB 1 AN ACT concerning qualifications for firefighters and 2 paramedics, amending named Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Municipal Code is amended by 6 adding Sections 10-1-38.2 and 10-2.1-16.1 as follows: 7 (65 ILCS 5/10-1-38.2 new) 8 Sec. 10-1-38.2. Firefighters and paramedics; minimum 9 qualifications. 10 (a) Any person hired, or assigned pursuant to a contract 11 for services, by a municipality on or after the effective 12 date of this amendatory Act of the 91st General Assembly to 13 perform duties, on either a full-time or part-time basis, 14 that involve (i) controlling and extinguishing fire, (ii) 15 providing emergency medical services, or (iii) a combination 16 of those duties must meet the minimum hiring standards and 17 qualifications for service provided in Section 10-1-7 plus 18 any additional standards required of firefighters appointed 19 from a register of eligibles. 20 (b) A home rule unit may not prescribe hiring standards 21 and qualifications for firefighters and paramedics that are 22 inconsistent with provisions of this Section 10-1-38.2. This 23 Section is a limitation under subsection (i) of Section 6 of 24 Article VII of the Illinois Constitution on the concurrent 25 exercise by home rule units of powers and functions exercised 26 by the State. 27 (c) This Section 10-1-38.2 does not apply to any 28 municipality with a population of more than 1,000,000. 29 (65 ILCS 5/10-2.1-16.1 new) 30 Sec. 10-2.1-16.1. Firefighters and paramedics; minimum -2- LRB9101506MWgcB 1 qualifications. 2 (a) Any person hired, or assigned pursuant to a contract 3 for services, by a municipality on or after the effective 4 date of this amendatory Act of the 91st General Assembly to 5 perform duties, on either a full-time or part-time basis, 6 that involve (i) controlling and extinguishing fire, (ii) 7 providing emergency medical services, or (iii) a combination 8 of those duties must meet the minimum hiring standards and 9 qualifications for service provided in Section 10-2.1-6 plus 10 any additional standards required of firefighters appointed 11 from a register of eligibles. 12 (b) A home rule unit may not prescribe hiring standards 13 and qualifications for firefighters and paramedics that are 14 inconsistent with provisions of this Section 10-2.1-16.1. 15 This Section is a limitation under subsection (i) of Section 16 6 of Article VII of the Illinois Constitution on the 17 concurrent exercise by home rule units of powers and 18 functions exercised by the State. 19 (c) This Section 10-2.1-16.1 does not apply to any 20 municipality with a population of more than 1,000,000. 21 Section 15. The Fire Protection District Act is amended 22 by adding Section 16.13e as follows: 23 (70 ILCS 705/16.13e new) 24 Sec. 16.13e. Firefighters and paramedics; minimum 25 qualifications. Any person hired, or assigned pursuant to a 26 contract for services, by a fire protection district on or 27 after the effective date of this amendatory Act of the 91st 28 General Assembly to perform duties, on either a full-time or 29 part-time basis, that involve (i) controlling and 30 extinguishing fire, (ii) providing emergency medical 31 services, or (iii) a combination of those duties must meet 32 the minimum hiring standards and qualifications for service -3- LRB9101506MWgcB 1 provided in Section 16.06 plus any additional standards 2 required of firefighters appointed from a register of 3 eligibles. 4 Section 90. The State Mandates Act is amended by adding 5 Section 8.23 as follows: 6 (30 ILCS 805/8.23 new) 7 Sec. 8.23. Exempt mandate. Notwithstanding Sections 6 8 and 8 of this Act, no reimbursement by the State is required 9 for the implementation of any mandate created by this 10 amendatory Act of the 91st General Assembly. 11 Section 99. Effective date. This Act takes effect upon 12 becoming law.
