Amend Senate Bill 849, AS AMENDED, 3 by inserting immediately below Section 15 of the bill the 4 following: 5 "Section 20. The Mental Health and Developmental 6 Disabilities Confidentiality Act is amended by changing 7 Section 9.2 as follows: 8 (740 ILCS 110/9.2) 9 Sec. 9.2. Interagency disclosure of recipient 10 information. For the purposes of continuity of care, the 11 Department of Human Services (as successor to the Department 12 of Mental Health and Developmental Disabilities),and13 community agencies funded by the Department of Human Services 14 in that capacity, and jails operated by any county of this 15 State may disclose a recipient's record or communications, 16 without consent, to each other, but only for the purpose of 17 admission, treatment, planning, or discharge. Entities shall 18 not redisclose any personally identifiable information, 19 unless necessary for admission, treatment, planning, or 20 discharge of the identified recipient to another setting. No 21 records or communications may be disclosed to a county jail 22 pursuant to this Section unless the Department has entered -2- LRB9106073SMdvam04 1 into a written agreement with the county jail requiring that 2 the county jail adopt written policies and procedures 3 designed to ensure that the records and communications are 4 disclosed only to those persons employed by or under contract 5 to the county jail who are involved in the provision of 6 mental health services to inmates and that the records and 7 communications are protected from further disclosure. 8 (Source: P.A. 88-484; 89-507, eff. 7-1-97.)".
