91_SB0839eng SB839 Engrossed LRB9105964WHdv 1 AN ACT to amend the Local Governmental and Governmental 2 Employees Tort Immunity Act by adding Section 3-106.1. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Local Governmental and Governmental 6 Employees Tort Immunity Act is amended by adding Section 7 3-106.1 as follows: 8 (745 ILCS 10/3-106.1 new) 9 Sec. 3-106.1. Property used by bicyclists. Neither a 10 local public entity nor a public employee shall be liable for 11 an injury to a bicyclist where the liability is based on the 12 existence of a condition of any street or highway, bike lane, 13 bike route, or bike path unless the local public entity or 14 public employee is guilty of willful and wanton misconduct 15 proximately causing the injury.
