 1                    AMENDMENT TO SENATE BILL 770

 2        AMENDMENT NO.     .  Amend Senate Bill 770  by  replacing
 3    all of Section 10 with the following:

 4        "Section  10.   The  Illinois Forestry Development Act is
 5    amended by re-enacting and changing Section 6a as follows:

 6        (525 ILCS 15/6a) (from Ch. 96 1/2, par. 9106a)
 7        (This Section had an internal repeal  date  of  12-31-98.
 8    Public  Act  90-809, which became law and took effect on that
 9    date, replaced 12-31-98 with 12-31-2008.)
10        Sec. 6a. Illinois Forestry Development Council.
11        (a)  The Illinois Forestry Development Council is  hereby
12    recreated   by  this  amendatory  Act  of  the  91st  General
13    Assembly.
14        (b)  The Council shall consist of 24 members appointed as
15    follows:
16             (1)  four  members  of  the  General  Assembly,  one
17        appointed by the President of the Senate,  one  appointed
18        by  the  Senate  Minority  Leader,  one  appointed by the
19        Speaker  of  the  House  of  Representatives,   and   one
20        appointed by the House Minority Leader;
21             (2)  one   member   appointed  by  the  Governor  to
22        represent the Governor;

 1             (3)  the Directors of  the  Departments  of  Natural
 2        Resources,   Agriculture,   and  Commerce  and  Community
 3        Affairs, the Executive  Director  of  the  Illinois  Farm
 4        Development  Authority, and the Director of the Office of
 5        Rural Affairs, or their designees;
 6             (4)  the chairman of the Department of Forestry or a
 7        forestry  academician,   appointed   by   the   Dean   of
 8        Agriculture    at   Southern   Illinois   University   at
 9        Carbondale;
10             (5)  the head of the Department of Natural Resources
11        and Environmental Sciences  or  a  forestry  academician,
12        appointed by the Dean of Agriculture at the University of
13        Illinois;
14             (6)  two  members,  appointed  by  the Governor, who
15        shall be private timber growers;
16             (7)  one member, appointed by the president  of  the
17        Illinois Wood Products Association, who shall be involved
18        in primary forestry industry;
19             (8)  one  member,  appointed by the president of the
20        Illinois Wood Products Association, who shall be involved
21        in secondary forestry industry;
22             (9)  one  member  who  is   actively   involved   in
23        environmental issues, appointed by the Governor;
24             (10)  the  president  of the Association of Illinois
25        Soil and Water Conservation Districts;
26             (11)  two  persons  who  are  actively  engaged   in
27        farming, appointed by the Governor;
28             (12)  one  member,  appointed by the Governor, whose
29        primary area of expertise is urban forestry;
30             (13)  one member appointed by the President  of  the
31        Illinois Arborists Association;
32             (14)  the  Supervisor of the Shawnee National Forest
33        and the United States Department of  Agriculture  Natural
34        Resource Conservation Service's State Conservationist, ex

 1        officio, or their designees.
 2        (c)  Members   of   the   Council   shall  serve  without
 3    compensation but shall  be  reimbursed  for  actual  expenses
 4    incurred  in  the  performance  of their duties which are not
 5    otherwise reimbursed.
 6        (d)  The Council  shall  select  from  its  membership  a
 7    chairperson   and   such   other  officers  as  it  considers
 8    necessary.
 9        (e)  Other individuals, agencies and organizations may be
10    invited to participate as deemed advisable by the Council.
11        (f)  The Council shall study and  evaluate  the  forestry
12    resources  and  forestry  industry  of Illinois.  The Council
13    shall:
14             (1)  determine the magnitude, nature and  extent  of
15        the State's forestry resources;
16             (2)  determine   current  uses  and  project  future
17        demand for forest  products,  services  and  benefits  in
18        Illinois;
19             (3)  determine    and    evaluate    the   ownership
20        characteristics of the State's forests, the  motives  for
21        forest  ownership and the success of incentives necessary
22        to stimulate development of forest resources;
23             (4)  determine   the   economic   development    and
24        management   opportunities   that   could   result   from
25        improvements   in   local  and  regional  forest  product
26        marketing and from the establishment of new or additional
27        wood-related businesses in Illinois;
28             (5)  confer  with  and  offer  assistance   to   the
29        Illinois  Farm  Development  Authority  relating  to  its
30        implementation  of  forest  industry  assistance programs
31        authorized by the Illinois Farm Development Act;
32             (6)  determine  the  opportunities  for   increasing
33        employment  and  economic  growth  through development of
34        forest resources;

 1             (7)  determine the effect  of  current  governmental
 2        policies  and  regulations on the management of woodlands
 3        and the location of wood products markets;
 4             (8)  determine the staffing and  funding  needs  for
 5        forestry  and  other conservation programs to support and
 6        enhance forest resources development;
 7             (9)  determine  the  needs  of  forestry   education
 8        programs in this State;
 9             (10)  confer   with  and  offer  assistance  to  the
10        Department  of  Natural   Resources   relating   to   the
11        implementation   of   urban  forestry  assistance  grants
12        pursuant to the Urban and Community  Forestry  Assistance
13        Act; and
14             (11)  determine soil and water conservation benefits
15        and  wildlife  habitat enhancement opportunities that can
16        be promoted through approved forestry management plans.
17        (g)  The  Council  shall  report  (i)  its  findings  and
18    recommendations  for  future  State  action  and   (ii)   its
19    evaluation  of  Urban/Community Forestry Assistance Grants to
20    the General Assembly no later than July 1 of each year.
21        (h)  This Section 6a is repealed December 31, 2008.
