91_SB0726 LRB9105769RCdv 1 AN ACT to amend the Criminal Code of 1961 by adding 2 Section 17-23. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 adding Section 17-23 as follows: 7 (720 ILCS 5/17-23 new) 8 Sec. 17-23. Taking the identity of another person. 9 (a) A person commits the offense of taking the identity 10 of another person if the person knowingly takes the name, 11 birth date, or social security number of another person, 12 without the consent of that other person, and with the intent 13 to obtain or use the other person's identity for any unlawful 14 purpose or to cause economic loss to another person. 15 (b) Sentence. 16 (1) Except as otherwise provided in paragraph (2) 17 of this subsection (b), taking the identity of another 18 person is a Class A misdemeanor. 19 (2) Taking the identity of another person for the 20 purpose of evading a peace officer is a Class 4 felony.
