1 AN ACT to amend the Nursing Home Care Act by adding
2 Section 3-601 and 3-602.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Nursing Home Care Act is amended by
6 adding Section 3-601 and 3-602 as follows:
7 (210 ILCS 45/3-601) (from Ch. 111 1/2, par. 4153-601)
8 Sec. 3-601. The owner and licensee are liable to a
9 resident for any intentional or negligent act or omission of
10 their agents or employees which injures the resident. For the
11 purposes of this Section, "injures" includes, but is not
12 limited to, causing the death of the resident.

15 Sec. 3-602. The licensee shall pay the actual damages and
16 costs and attorney's fees to a facility resident whose
17 rights, as specified in Part 1 of Article II of this Act, are
18 violated. In addition, exemplary damages may be awarded in
19 all cases of wilful and wanton misconduct committed by the
20 licensee or its agents or employees.

22 Section 99. Effective date. This Act takes effect upon
23 becoming law.
