 1        AN  ACT  to amend the Health Care Surrogate Act by adding
 2    Section 60.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The Health Care Surrogate Act is amended by
 6    adding Section 60 as follows:

 7        (755 ILCS 40/60 new)
 8        Sec. 60.  Health care surrogate; specific  mental  health
 9    services.
10        (a)  In  this  Section, "specific mental health services"
11    means the  administration of authorized involuntary treatment
12    as defined in Section   1-121.5  of  the  Mental  Health  and
13    Developmental  Disabilities  Code  or   admission to a mental
14    health facility as defined in Section 1-114 of that  Code.
15        (b) A  surrogate  decision  maker,  other  than  a  court
16    appointed guardian, may not consent to specific mental health
17    services  for  an  adult  patient. A surrogate decision maker
18    may, however, petition for the  provision of specific  mental
19    health   services   pursuant   to   the   Mental  Health  and
20    Developmental Disabilities Code.

21        Section 99.   Effective  date.   This  Act  takes  effect
22    January 1, 2000.
