 1        AN ACT to amend the Children's Health  Insurance  Program
 2    Act by changing Sections 30, 55, and 60.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Children's Health Insurance  Program  Act
 6    is amended by changing Sections 30, 55, and 60 as follows:

 7        (215 ILCS 106/30)
 8        (Section scheduled to be repealed on June 30, 2001)
 9        Sec. 30.  Cost sharing.
10        (a)  Children  enrolled  in  a  health  benefits  program
11    pursuant to subdivision (a)(2) of Section 25 shall be subject
12    to the following cost sharing requirements:
13             (1)  There  shall  be  no  co-payment  required  for
14        well-baby  or  well-child care, including age-appropriate
15        immunizations as required under federal law.
16             (2)  Health  insurance  premiums  for  children   in
17        families  whose  household  income is at or above 150% of
18        the federal  poverty  level  shall  be  payable  monthly,
19        subject  to rules promulgated by the Department for grace
20        periods and advance payments, and shall be as follows:
21                  (A)  $15 per month for one child.
22                  (B)  $25 per month for 2 children.
23                  (C)  $30 per month for 3 or more children.
24             (3)  Co-payments  for  children  in  families  whose
25        income is at or below 150% of the federal poverty  level,
26        at  a  minimum  and to the extent permitted under federal
27        law, shall be $2 for all medical visits and prescriptions
28        provided under this Act.
29             (4)  Co-payments  for  children  in  families  whose
30        income is at or above 150% of the federal poverty  level,
31        at  a  minimum  and to the extent permitted under federal

 1        law shall be as follows:
 2                  (A)  $5 for medical visits.
 3                  (B)  $3 for generic prescriptions  and  $5  for
 4             brand name prescriptions.
 5                  (C)  $25   for   emergency   room   use  for  a
 6             non-emergency situation as defined by the Department
 7             by rule.
 8             (5)  The maximum amount  of  out-of-pocket  expenses
 9        for co-payments shall be $100 per family per year.
10        (b)  Individuals enrolled in a privately sponsored health
11    insurance  plan  pursuant to subdivision (a)(1) of Section 25
12    shall be subject to the cost sharing provisions as stated  in
13    the privately sponsored health insurance plan.

17        Sec.  55.   Contracts  with non-governmental bodies.  All
18    contracts with non-governmental bodies that are determined by
19    the Department to be necessary for the implementation of this
20    Act Section are deemed to be purchase of care as  defined  in
21    the Illinois Procurement Code.

25        Sec.  60.  Emergency rulemaking.  Prior to June 30, 1999,
26    the Department may adopt rules  necessary  to  establish  and
27    implement  this  Act  Section  through  the  use of emergency
28    rulemaking in accordance with Section 5-45  of  the  Illinois
29    Administrative  Procedure Act.  For purposes of that Act, the
30    General  Assembly  finds  that  the  adoption  of  rules   to
31    implement  this  Act  Section  is  deemed  an  emergency  and
32    necessary for the public interest, safety, and welfare.

 2        Section  99.  Effective date.  This Act takes effect upon
 3    becoming law.
