91_SB0389enr SB389 Enrolled LRB9100726NTsbA 1 AN ACT concerning education, amending named Acts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The State Finance Act is amended by adding 5 Sections 5.490, 5.491, and 5.492 as follows: 6 (30 ILCS 105/5.490 new) 7 Sec. 5.490. The State Board of Education Fund. This 8 Section is repealed 4 years after the effective date of this 9 amendatory Act of the 91st General Assembly. 10 (30 ILCS 105/5.491 new) 11 Sec. 5.491. The State Board of Education Special Purpose 12 Trust Fund. This Section is repealed 4 years after the 13 effective date of this amendatory Act of the 91st General 14 Assembly. 15 (30 ILCS 105/5.492 new) 16 Sec. 5.492. The Private Business and Vocational Schools 17 Fund. This Section is repealed 4 years after the effective 18 date of this amendatory Act of the 91st General Assembly. 19 Section 10. The School Code is amended by adding 20 Sections 2-3.126 and 2-3.127 as follows: 21 (105 ILCS 5/2-3.126 new) 22 Sec. 2-3.126. State Board of Education Fund. The State 23 Board of Education Fund is created as a special fund in the 24 State treasury. Unless specifically directed to be deposited 25 into any other funds or into the General Revenue Fund, all 26 moneys received by the State Board of Education in connection 27 with any fees, registration amounts, or other moneys SB389 Enrolled -2- LRB9100726NTsbA 1 collected by the State Board of Education for various 2 purposes shall be deposited into this Fund. Moneys in this 3 Fund shall be used, subject to appropriation by the General 4 Assembly, by the State Board of Education for expenses 5 incurred in administering programs, initiatives, and 6 activities implemented or supported by the State Board of 7 Education as authorized by statute or rule. The State Board 8 of Education may expend moneys in this Fund in such amounts 9 and at such times as it deems necessary or desirable, 10 including for payment of administrative costs, staff 11 services, and costs for other lawful purposes. Moneys in 12 this Fund shall be used together with and supplemental to 13 regular appropriations to the State Board of Education for 14 any purpose, and nothing in this Section shall be construed 15 to prohibit appropriations from the General Revenue Fund for 16 expenses incurred in the administration of programs, 17 initiatives, or activities implemented or supported by the 18 State Board of Education. This Section is repealed 4 years 19 after the effective date of this amendatory Act of the 91st 20 General Assembly. 21 (105 ILCS 5/2-3.127 new) 22 Sec. 2-3.127. State Board of Education Special Purpose 23 Trust Fund. The State Board of Education Special Purpose 24 Trust Fund is created as a special fund in the State 25 treasury. Unless specifically directed to be deposited into 26 other funds, all moneys received by the State Board of 27 Education from federal aid and grants and from gifts and 28 grants from any source, public or private, shall be deposited 29 into this Fund. Moneys in this Fund shall be used, subject 30 to appropriation by the General Assembly, by the State Board 31 of Education for the purposes established by the federal aid 32 or grants or other gifts or grants. This Section is repealed 33 4 years after the effective date of this amendatory Act of SB389 Enrolled -3- LRB9100726NTsbA 1 the 91st General Assembly. 2 Section 15. The Private Business and Vocational Schools 3 Act is amended by adding Section 11.5 as follows: 4 (105 ILCS 425/11.5 new) 5 Sec. 11.5. Private Business and Vocational Schools Fund. 6 The Private Business and Vocational Schools Fund is created 7 as a special fund in the State treasury. All moneys received 8 by the Superintendent from application and renewal fees under 9 Sections 10 and 11 of this Act shall be deposited into this 10 Fund. Moneys in this Fund shall be used, subject to 11 appropriation by the General Assembly, by the Board, with the 12 advice and recommendation of the Superintendent, to provide 13 technology, equipment, staff, professional development, and 14 other resources necessary to support records management and 15 other projects in administering this Act. The State Board 16 may expend moneys in this Fund in such amounts and at such 17 times as it deems necessary or desirable for the purposes of 18 this Act. This Section is repealed 4 years after the 19 effective date of this amendatory Act of the 91st General 20 Assembly. 21 Section 99. Effective date. This Act takes effect upon 22 becoming law.
