Amend Senate Bill 385 by replacing 3 the title with the following: 4 "AN ACT to amend the Public Utilities Act by changing 5 Section 13-406."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Public Utilities Act is amended by 9 changing Section 13-406 as follows: 10 (220 ILCS 5/13-406) (from Ch. 111 2/3, par. 13-406) 11 (Section scheduled to be repealed on July 1, 2001) 12 Sec. 13-406. Discontinuation or abandonment of 13 telecommunication service. No telecommunications carrier 14 offering or providing noncompetitive telecommunications 15 service pursuant to a valid Certificate of Service Authority 16 or certificate of public convenience and necessity shall 17 discontinue or abandon such service once initiated until and 18 unless it shall demonstrate, and the Commission finds, after 19 notice and hearing, that such discontinuance or abandonment 20 will not deprive customers of any necessary or essential 21 telecommunications service or access thereto and is not -2- LRB9102460JSpcam 1 otherwise contrary to the public interest. No 2 telecommunications carrier offering or providing competitive 3 telecommunications service shall discontinue or abandon such 4 service once initiated except upon 30 days notice to the 5 Commission and affected customers. The Commission may, upon 6 its own motion or upon complaint, investigate the proposed 7 discontinuance or abandonment of a competitive 8 telecommunications service and may, after notice and hearing, 9 prohibit such proposed discontinuance or abandonment if the 10 Commission finds that it would be contrary to the public 11 interest. 12 (Source: P.A. 84-1063.)".
