Amend Senate Bill 349 on page 2, by 3 deleting lines 2 through 16; and 4 on page 2, lines 18 and 19, by deleting "or receives 5 telephone calls from"; and 6 on page 2, line 21, by deleting "or receives"; and 7 on page 5, immediately below line 30, by inserting the 8 following: 9 "(21) A person, partnership, association, corporation, 10 or any other entity licensed under the Residential Mortgage 11 License Act of 1987."; and 12 on page 11, line 3, after the period, by inserting the 13 following: 14 "For offers of consumer credit products subject to the 15 federal Truth in Lending Act, 15 U.S.C. 1601 et seq., and 16 Regulation Z, 12 C.F.R. Part 226, compliance with the 17 disclosure requirements under the Truth in Lending Act and 18 Regulation Z shall constitute compliance with this 19 subdivision (b)(1)."; and 20 on page 13, by replacing lines 25 through 28 with the 21 following: -2- LRB9101743SMdvam08 1 "(1) Telephone calls in which the sale of goods or 2 services is not completed and payment, payment information, 3 and authorization of payment are not obtained until: 4 (A) there has been a face-to-face presentation by 5 the seller; or 6 (B) there is a written contract signed by the 7 consumer."; and 8 by replacing line 33 on page 13 and lines 1 through 23 on 9 page 14 with the following: 10 "(4) Telephone calls made by a collection agency"; and 11 on page 14, by deleting lines 26 through 29; and 12 by replacing lines 21 through 31 on page 18 and lines 1 13 through 21 on page 19 with the following: 14 "Section 70. Telemarketing Fraud Enforcement Fund. 15 There"; and 16 on page 19, line 30, by replacing "80" with "75"; and 17 on page 20, line 2, by replacing "85" with "80".
