 1                    AMENDMENT TO SENATE BILL 336

 2        AMENDMENT NO.     .  Amend Senate Bill 336,  AS  AMENDED,
 3    by replacing the title with the following:
 4        "AN  ACT  to  amend  the  Bingo  License  and  Tax Act by
 5    changing Section 2."; and

 6    by replacing everything after the enacting  clause  with  the
 7    following:

 8        "Section  5.  The Bingo License and Tax Act is amended by
 9    changing Section 2 as follows:

10        (230 ILCS 25/2) (from Ch. 120, par. 1102)
11        Sec. 2.  The  conducting  of  bingo  is  subject  to  the
12    following restrictions:
13        (1)  The  entire  net  proceeds  from  bingo play must be
14    exclusively  devoted  to   the   lawful   purposes   of   the
15    organization permitted to conduct that game.
16        (2)  No   person   except  a  bona  fide  member  of  the
17    sponsoring organization or a bona fide member of an auxiliary
18    organization, substantially all of whose members are  spouses
19    of  members of the sponsoring organization may participate in
20    the management or operation of the game.
21        (3)  No person may receive any remuneration or profit for

 1    participating in the management or  operation  of  the  game,
 2    except  that  if  an  organization licensed under this Act is
 3    associated with a school or  other  educational  institution,
 4    that  school  or institution may reduce tuition or fees for a
 5    designated pupil based on participation in the management  or
 6    operation  of the game by any member of the organization. The
 7    extent to which tuition and fees  are  reduced  shall  relate
 8    proportionately  to  the  amount  of  time volunteered by the
 9    member, as determined by  the  school  or  other  educational
10    institution.
11        (4)  Except  as  provided  in  item  (4.1), the aggregate
12    retail value of all prizes  or  merchandise  awarded  in  any
13    single  day  of  bingo  may not exceed $2,250, except that in
14    adjoining counties  having  200,000  to  275,000  inhabitants
15    each,  and  in  counties which are adjacent to either of such
16    adjoining counties and are adjacent to a total  of  not  more
17    than 2 counties in this State, and in any municipality having
18    2,500  or  more  inhabitants  and  within  one  mile  of such
19    adjoining and  adjacent  counties  having  less  than  25,000
20    inhabitants,  2 additional bingo games may be conducted after
21    the $2,250 limit has been reached.  The prize awarded for any
22    one game, including any game  conducted  after  reaching  the
23    $2,250  limit  as  authorized  in this paragraph (4), may not
24    exceed $500 cash or its equivalent.
25        (4.1)  Notwithstanding the provisions of  item  (4),  the
26    Department may issue a special prize license to a licensee if
27    the  county in which the licensee conducts bingo approves the
28    special  prize  license.   A  special  prize  licensee  shall
29    authorize a license to  award  prizes  or  merchandise  in  a
30    single  day  of bingo that has an aggregate retail value that
31    exceeds the limits imposed under item (4) but does not exceed
32    $10,000.  A special prize license authorized under this  item
33    (4.1)  shall  authorize  the  licensee  to  award  prizes  or
34    merchandise at the higher limit authorized in this item (4.1)

 1    on  2  days  per  year  and  shall not permit the licensee to
 2    conduct gambling on days other than  as  authorized  in  this
 3    Act.
 4        (5)  The number of games may not exceed 25 in any one day
 5    including   regular  and  special  games,  except  that  this
 6    restriction on the number of games shall not apply  to  bingo
 7    conducted  at the Illinois State Fair or any county fair held
 8    in Illinois.
 9        (6)  The price paid for a single card under  the  license
10    may  not  exceed  $1  and  such card is valid for all regular
11    games on that day of bingo. A maximum of 5 special games  may
12    be  held  on  each bingo day, except that this restriction on
13    the  number  of  special  games  shall  not  apply  to  bingo
14    conducted at the Illinois State Fair or any county fair  held
15    in Illinois. The price for a single special game card may not
16    exceed 50 cents.
17        (7)  The  number  of  bingo  days conducted by a licensee
18    under this Act is limited to one per week, except as follows:
19             (i)  Bingo may be conducted in accordance  with  the
20        terms  of  a special operator's permit or limited license
21        issued under subdivision (3) of Section 1.
22             (ii)  Bingo may be conducted at the  Illinois  State
23        Fair   or   any   county  fair  held  in  Illinois  under
24        subdivision (3) of Section 1.
25             (iii)  A licensee  which  cancels  a  day  of  bingo
26        because  of  inclement  weather  or  because the day is a
27        holiday or the eve of a holiday may, after giving  notice
28        to  the  Department,  conduct bingo on an additional date
29        which falls on a day of  the  week  other  than  the  day
30        authorized   under   the   license.    As  used  in  this
31        subdivision (iii), "holiday" means any  of  the  holidays
32        listed  in  Section  17  of  the Promissory Note and Bank
33        Holiday Act.
34        (8)  A licensee may rent a premises on which  to  conduct

 1    bingo  only  from  an  organization  which  is  licensed as a
 2    provider of premises  or  exempt  from  license  requirements
 3    under this Act. If the organization providing the premises is
 4    a  metropolitan  exposition,  auditorium, and office building
 5    authority created by State law, a licensee may enter  into  a
 6    rental   agreement  with  the  organization  authorizing  the
 7    licensee and the organization to share the gross proceeds  of
 8    bingo games; however, the organization shall not receive more
 9    than 50% of the gross proceeds.
10        (9)  No  person  under  the  age  of 18 years may play or
11    participate in the conducting of bingo.  Any person under the
12    age of 18 years may be within the area where bingo  is  being
13    played only when accompanied by his parent or guardian.
14        (10)  The promoter of bingo games must have a proprietary
15    interest in the game promoted.
16        (11)  Raffles  or  other  forms of gambling prohibited by
17    law shall not be conducted on the  premises  where  bingo  is
18    being   conducted,  except  that  pull  tabs  and  jar  games
19    conducted under the Illinois Pull Tabs and Jar Games Act  may
20    be  conducted on the premises where bingo is being conducted.
21    Prizes awarded in pull  tabs  and  jar  games  shall  not  be
22    included in the bingo prize limitation.
23        (12)  An organization holding a special operator's permit
24    or  a limited license may, as one of the occasions allowed by
25    such permit or license, conduct bingo  for  a  maximum  of  2
26    consecutive  days,  during  each  day  of which the number of
27    games may exceed 25, and regular game cards need not be valid
28    for all regular games.  If only noncash  prizes  are  awarded
29    during  such  occasions, the prize limits stated in paragraph
30    (4) of this Section shall not apply, provided that the retail
31    value of noncash prizes for any single game shall not  exceed
32    $150.
