91_SB0323 LRB9102825SMpr 1 AN ACT to amend the Abused Neglected Child Reporting Act 2 by changing Sections 4.02 and 6. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Abused and Neglected Child Reporting Act 6 is amended by changing Sections 4.02 and 6 as follows: 7 (325 ILCS 5/4.02) (from Ch. 23, par. 2054.02) 8 Sec. 4.02. Any physician who willfully fails to report 9 suspected child abuse or neglect as required by this Act 10 shall be referred to the Illinois State Medical Disciplinary 11 Board for action in accordance with paragraph 22 of Section 12 22 of the Medical Practice Act of 1987. Any dentist who 13 willfully fails to report suspected child abuse or neglect as 14 required by this Act shall be referred to the Department of 15 Professional Regulation for action in accordance with 16 paragraph 19 of Section 23 of the Illinois Dental Practice 17 Act. Any other person required by this Act to report 18 suspected child abuse and neglect who willfully fails to 19 report such shall be guilty of a Class A misdemeanor. 20 (Source: P.A. 86-1004.) 21 (325 ILCS 5/6) (from Ch. 23, par. 2056) 22 Sec. 6. Any person required to investigate cases of 23 suspected child abuse or neglect may take or cause to be 24 taken, at Department expense, color photographs and x-rays of 25 the child who is the subject of a report, and color 26 photographs of the physical environment in which the alleged 27 abuse or neglect has taken place. Any health professional who 28 intends to file a report of suspected child abuse or neglect 29 pursuant to the requirements of this Act may take or cause to 30 be taken, at Department expense, color photographs and x-rays -2- LRB9102825SMpr 1 of the child who is the subject of the report. The person 2 seeking to take such photographs or x-rays shall make every 3 reasonable effort to notify the person responsible for the 4 child's welfare. 5 (Source: P.A. 84-611.)
