91_SB0248 LRB9102561PTpk 1 AN ACT concerning breast and cervical cancer. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Civil Administrative Code of Illinois is 5 amended by changing Section 55.70 as follows: 6 (20 ILCS 2310/55.70) 7 Sec. 55.70. Penny Severns Breast and Cervical Cancer 8 Research Fund. From funds appropriated from the Penny Severns 9 Breast and Cervical Cancer Research Fund, the Department of 10 Public Health shall award grants to eligible physicians, 11 hospitals, laboratories, education institutions, and other 12 organizations and persons to enable organizations and persons 13 to conduct research. For the purposes of this Section, 14 "research" includes, but is not limited to, expenditures to 15 develop and advance the understanding, techniques, and 16 modalities effective in early detection, prevention, cure, 17 screening, and treatment of breast and cervical cancer and 18 may include clinical trials. 19 Moneys received for the purposes of this Section, 20 including but not limited to income tax checkoff receipts and 21 gifts, grants, and awards from private foundations, nonprofit 22 organizations, other governmental entities and persons shall 23 be deposited into the Penny Severns Breast and Cervical 24 Cancer Research Fund, which is hereby created as a special 25 fund in the State treasury. 26 The Department of Public Health shall create an advisory 27 committee with members from, but not limited to, the Illinois 28 Chapter of the American Cancer Society, Y-Me, the Susan G. 29 Komen Foundation, and the State Board of Health for the 30 purpose of awarding research grants under this Section. 31 Members of the advisory committee shall not be eligible for -2- LRB9102561PTpk 1 any financial compensation or reimbursement. 2 (Source: P.A. 88-85; 88-459; 88-670, eff. 12-2-94.) 3 Section 10. The State Finance Act is amended by changing 4 Section 5.362 as follows: 5 (30 ILCS 105/5.362) 6 Sec. 5.362. The Illinois Income Tax Act is amended by 11 changing Sections 507L, 509, and 510 as follows: 12 (35 ILCS 5/507L) 13 Sec. 507L. Penny Severns Breast and Cervical Cancer 14 Research Fund checkoff. Beginning with taxable years ending 15 on December 31, 19991993, the Department shall print on its 16 standard individual income tax form a provision indicating 17 that if the taxpayer wishes to contribute to the Penny 18 Severns Breast and Cervical Cancer Research Fund as 19 authorized by this amendatory Act of the 91st General 20 AssemblyPublic Acts 88-85 and 88-459, he or she may do so by 21 stating the amount of the contribution (not less than $1) on 22 the return and that the contribution will reduce the 23 taxpayer's refund or increase the amount of the payment to 24 accompany the return. Failure to remit any amount of 25 increased payment shall reduce the contribution accordingly. 26 This Section shall not apply to an amended return. 27 (Source: P.A. 88-85; 88-459; 88-670, eff. 12-2-94.) 28 (35 ILCS 5/509) (from Ch. 120, par. 5-509) 29 Sec. 509. Tax checkoff explanations. All individual -3- LRB9102561PTpk 1 income tax return forms shall contain appropriate 2 explanations and spaces to enable the taxpayers to designate 3 contributions to the Child Abuse Prevention Fund, to the 4 Community Health Center Care Fund, to the Illinois Wildlife 5 Preservation Fund as required by the Illinois Non-Game 6 Wildlife Protection Act, to the Alzheimer's Disease Research 7 Fund as required by the Alzheimer's Disease Research Act, to 8 the Assistance to the Homeless Fund as required by this Act, 9 to the Heritage Preservation Fund as required by the Heritage 10 Preservation Act, to the Child Care Expansion Program Fund as 11 required by the Child Care Expansion Program Act, to the Ryan 12 White AIDS Victims Assistance Fund, to the Assistive 13 Technology for Persons with Disabilities Fund, to the 14 Domestic Violence Shelter and Service Fund, to the United 15 States Olympians Assistance Fund, to the Youth Drug Abuse 16 Prevention Fund, to the Persian Gulf Conflict Veterans Fund, 17 to the Literacy Advancement Fund, to the Ryan White Pediatric 18 and Adult AIDS Fund, to the Illinois Special Olympics 19 Checkoff Fund, to the Penny Severns Breast and Cervical 20 Cancer Research Fund, to the Korean War Memorial Fund, to the 21 Heart Disease Treatment and Prevention Fund, to the 22 Hemophilia Treatment Fund, to the Mental Health Research 23 Fund, to the Children's Cancer Fund, to the American Diabetes 24 Association Fund, to the Women in Military Service Memorial 25 Fund, and to the Meals on Wheels Fund. Each form shall 26 contain a statement that the contributions will reduce the 27 taxpayer's refund or increase the amount of payment to 28 accompany the return. Failure to remit any amount of 29 increased payment shall reduce the contribution accordingly. 30 If, on October 1 of any year, the total contributions to 31 any one of the funds made under this Section do not equal 32 $100,000 or more, the explanations and spaces for designating 33 contributions to the fund shall be removed from the 34 individual income tax return forms for the following and all -4- LRB9102561PTpk 1 subsequent years and all subsequent contributions to the fund 2 shall be refunded to the taxpayer. 3 (Source: P.A. 89-230, eff. 1-1-96; 89-324, eff. 8-13-95; 4 90-171, eff. 7-23-97; revised 10-31-98.) 5 (35 ILCS 5/510) (from Ch. 120, par. 5-510) 6 Sec. 510. Determination of amounts contributed. The 7 Department shall determine the total amount contributed to 8 each of the following: the Child Abuse Prevention Fund, the 9 Illinois Wildlife Preservation Fund, the Community Health 10 Center Care Fund, the Assistance to the Homeless Fund, the 11 Alzheimer's Disease Research Fund, the Heritage Preservation 12 Fund, the Child Care Expansion Program Fund, the Ryan White 13 AIDS Victims Assistance Fund, the Assistive Technology for 14 Persons with Disabilities Fund, the Domestic Violence Shelter 15 and Service Fund, the United States Olympians Assistance 16 Fund, the Youth Drug Abuse Prevention Fund, the Persian Gulf 17 Conflict Veterans Fund, the Literacy Advancement Fund, the 18 Ryan White Pediatric and Adult AIDS Fund, the Illinois 19 Special Olympics Checkoff Fund, the Penny Severns Breast and 20 Cervical Cancer Research Fund, the Korean War Memorial Fund, 21 the Heart Disease Treatment and Prevention Fund, the 22 Hemophilia Treatment Fund, the Mental Health Research Fund, 23 the Children's Cancer Fund, the American Diabetes 24 Association Fund, the Women in Military Service Memorial 25 Fund, and the Meals on Wheels Fund; and shall notify the 26 State Comptroller and the State Treasurer of the amounts to 27 be transferred from the General Revenue Fund to each fund, 28 and upon receipt of such notification the State Treasurer and 29 Comptroller shall transfer the amounts. 30 (Source: P.A. 89-230, eff. 1-1-96; 89-324, eff. 8-13-95; 31 90-171, eff. 7-23-97.) 32 Section 99.
