91_SB0226 LRB9100958NTsbA 1 AN ACT concerning higher education, amending named Acts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The University of Illinois Act is amended by 5 adding Section 20 as follows: 6 (110 ILCS 305/20 new) 7 Sec. 20. Full-time position requirements. 8 (a) In order to enhance the quality of university 9 instruction and provide for a more equitable treatment of 10 university faculty members, it shall be the policy of the 11 State of Illinois that part-time teachers (i) be used solely 12 to supplement and not to replace any existing full-time 13 tenured or nontenured faculty member, and (ii) be used solely 14 in those instances in which a full-time position cannot be 15 generated or when specialized services that no full-time 16 tenured or nontenured faculty member is competent to render 17 are required. 18 (b) The Board of Trustees shall achieve, on a phased-in 19 basis as provided in this subsection (b), a ratio between its 20 full-time faculty members and part-time teachers under which 21 at least 75% of all full-time equivalent teaching positions 22 at the University are held by full-time faculty members and 23 not more than 25% of all full-time equivalent teaching 24 positions at the University are held by part-time teachers; 25 provided that this subsection (b) shall not be construed to 26 prohibit job sharing of full-time positions. 27 Beginning with fiscal year 2000, and in each fiscal year 28 thereafter, the University shall use and apply not less than 29 33% of the amount by which the aggregate State funds received 30 by the University for the current fiscal year exceed the 31 aggregate State funds received by the University for the -2- LRB9100958NTsbA 1 immediately preceding fiscal year to (i) increase the number 2 of full-time equivalent teaching positions at the University 3 that are held by full-time faculty members and (ii) decrease 4 the number of full-time equivalent teaching positions at the 5 University that are held by part-time teachers. The 6 requirement of using a specified percentage of each fiscal 7 year's increase in the aggregate State funds received by the 8 University shall no longer apply to the University when at 9 least 75% of those full-time equivalent teaching positions 10 are held by full-time faculty members and not more than 25% 11 of those full-time equivalent teaching positions are held by 12 part-time teachers. 13 (c) The Board of Higher Education shall promulgate all 14 rules necessary to administer and implement the provisions of 15 this Section. 16 Section 10. The Southern Illinois University Management 17 Act is amended by adding Section 10 as follows: 18 (110 ILCS 520/10 new) 19 Sec. 10. Full-time position requirements. 20 (a) In order to enhance the quality of university 21 instruction and provide for a more equitable treatment of 22 university faculty members, it shall be the policy of the 23 State of Illinois that part-time teachers (i) be used solely 24 to supplement and not to replace any existing full-time 25 tenured or nontenured faculty member, and (ii) be used solely 26 in those instances in which a full-time position cannot be 27 generated or when specialized services that no full-time 28 tenured or nontenured faculty member is competent to render 29 are required. 30 (b) The Board shall achieve, on a phased-in basis as 31 provided in this subsection (b), a ratio between its 32 full-time faculty members and part-time teachers under which -3- LRB9100958NTsbA 1 at least 75% of all full-time equivalent teaching positions 2 at the University are held by full-time faculty members and 3 not more than 25% of all full-time equivalent teaching 4 positions at the University are held by part-time teachers; 5 provided that this subsection (b) shall not be construed to 6 prohibit job sharing of full-time positions. 7 Beginning with fiscal year 2000, and in each fiscal year 8 thereafter, the University shall use and apply not less than 9 33% of the amount by which the aggregate State funds received 10 by the University for the current fiscal year exceed the 11 aggregate State funds received by the University for the 12 immediately preceding fiscal year to (i) increase the number 13 of full-time equivalent teaching positions at the University 14 that are held by full-time faculty members and (ii) decrease 15 the number of full-time equivalent teaching positions at the 16 University that are held by part-time teachers. The Chicago State University Law is amended 28 by adding Section 5-115 as follows: 29 (110 ILCS 660/5-115 new) 30 Sec. 5-115. The Eastern Illinois University Law is 5 amended by adding Section 10-115 as follows: 6 (110 ILCS 665/10-115 new) 7 Sec. 10-115. The Governors State University Law is 16 amended by adding Section 15-115 as follows: 17 (110 ILCS 670/15-115 new) 18 Sec. 15-115. Full-time position requirements. 19 (a) In order to enhance the quality of university 20 instruction and provide for a more equitable treatment of 21 university faculty members, it shall be the policy of the 22 State of Illinois that part-time teachers (i) be used solely 23 to supplement and not to replace any existing full-time 24 tenured or nontenured faculty member, and (ii) be used solely 25 in those instances in which a full-time position cannot be 26 generated or when specialized services that no full-time 27 tenured or nontenured faculty member is competent to render 28 are required. 29 (b) The Board shall achieve, on a phased-in basis as 30 provided in this subsection (b), a ratio between its 31 full-time faculty members and part-time teachers under which 32 at least 75% of all full-time equivalent teaching positions -7- LRB9100958NTsbA 1 at the University are held by full-time faculty members and 2 not more than 25% of all full-time equivalent teaching 3 positions at the University are held by part-time teachers; 4 provided that this subsection (b) shall not be construed to 5 prohibit job sharing of full-time positions. 6 Beginning with fiscal year 2000, and in each fiscal year 7 thereafter, the University shall use and apply not less than 8 33% of the amount by which the aggregate State funds received 9 by the University for the current fiscal year exceed the 10 aggregate State funds received by the University for the 11 immediately preceding fiscal year to (i) increase the number 12 of full-time equivalent teaching positions at the University 13 that are held by full-time faculty members and (ii) decrease 14 the number of full-time equivalent teaching positions at the 15 University that are held by part-time teachers. The Illinois State University Law is amended 27 by adding Section 20-120 as follows: 28 (110 ILCS 675/20-120 new) 29 Sec. 20-120. The Northeastern Illinois University Law is 4 amended by adding Section 25-115 as follows: 5 (110 ILCS 680/25-115 new) 6 Sec. 25-115. The Northern Illinois University Law is 15 amended by adding Section 30-125 as follows: 16 (110 ILCS 685/30-125 new) 17 Sec. 30-125. Full-time position requirements. 18 (a) In order to enhance the quality of university 19 instruction and provide for a more equitable treatment of 20 university faculty members, it shall be the policy of the 21 State of Illinois that part-time teachers (i) be used solely 22 to supplement and not to replace any existing full-time 23 tenured or nontenured faculty member, and (ii) be used solely 24 in those instances in which a full-time position cannot be 25 generated or when specialized services that no full-time 26 tenured or nontenured faculty member is competent to render 27 are required. 28 (b) The Board shall achieve, on a phased-in basis as 29 provided in this subsection (b), a ratio between its 30 full-time faculty members and part-time teachers under which 31 at least 75% of all full-time equivalent teaching positions 32 at the University are held by full-time faculty members and -11- LRB9100958NTsbA 1 not more than 25% of all full-time equivalent teaching 2 positions at the University are held by part-time teachers; 3 provided that this subsection (b) shall not be construed to 4 prohibit job sharing of full-time positions. 5 Beginning with fiscal year 2000, and in each fiscal year 6 thereafter, the University shall use and apply not less than 7 33% of the amount by which the aggregate State funds received 8 by the University for the current fiscal year exceed the 9 aggregate State funds received by the University for the 10 immediately preceding fiscal year to (i) increase the number 11 of full-time equivalent teaching positions at the University 12 that are held by full-time faculty members and (ii) decrease 13 the number of full-time equivalent teaching positions at the 14 University that are held by part-time teachers. The Western Illinois University Law is 26 amended by adding Section 35-120 as follows: 27 (110 ILCS 690/35-120 new) 28 Sec. 35-120. Full-time position requirements. 29 (a) In order to enhance the quality of university 30 instruction and provide for a more equitable treatment of 31 university faculty members, it shall be the policy of the 32 State of Illinois that part-time teachers (i) be used solely -12- LRB9100958NTsbA 1 to supplement and not to replace any existing full-time 2 tenured or nontenured faculty member, and (ii) be used solely 3 in those instances in which a full-time position cannot be 4 generated or when specialized services that no full-time 5 tenured or nontenured faculty member is competent to render 6 are required. 7 (b) The Board shall achieve, on a phased-in basis as 8 provided in this subsection (b), a ratio between its 9 full-time faculty members and part-time teachers under which 10 at least 75% of all full-time equivalent teaching positions 11 at the University are held by full-time faculty members and 12 not more than 25% of all full-time equivalent teaching 13 positions at the University are held by part-time teachers; 14 provided that this subsection (b) shall not be construed to 15 prohibit job sharing of full-time positions. 16 Beginning with fiscal year 2000, and in each fiscal year 17 thereafter, the University shall use and apply not less than 18 33% of the amount by which the aggregate State funds received 19 by the University for the current fiscal year exceed the 20 aggregate State funds received by the University for the 21 immediately preceding fiscal year to (i) increase the number 22 of full-time equivalent teaching positions at the University 23 that are held by full-time faculty members and (ii) decrease 24 the number of full-time equivalent teaching positions at the 25 University that are held by part-time teachers. The 26 requirement of using a specified percentage of each fiscal 27 year's increase in the aggregate State funds received by the 28 University shall no longer apply to the University when at 29 least 75% of those full-time equivalent teaching positions 30 are held by full-time faculty members and not more than 25% 31 of those full-time equivalent teaching positions are held by 32 part-time teachers. 33 (c) The Board of Higher Education shall promulgate all 34 rules necessary to administer and implement the provisions of -13- LRB9100958NTsbA 1 this Section. 2 Section 50. The Public Community College Act is amended 3 by adding Section 3-26.2 as follows: 4 (110 ILCS 805/3-26.2 new) 5 Sec. 3-26.2. Full-time position requirements. 6 (a) In order to enhance the quality of community college 7 instruction and provide for a more equitable treatment of 8 community college faculty members, it shall be the policy of 9 the State of Illinois that part-time teachers (i) be used 10 solely to supplement and not to replace any existing 11 full-time tenured or nontenured faculty member, and (ii) be 12 used solely in those instances in which a full-time position 13 cannot be generated or when specialized services that no 14 full-time tenured or nontenured faculty member is competent 15 to render are required. 16 (b) Each community college board shall achieve, on a 17 phased-in basis as provided in this subsection (b), a ratio 18 between its full-time faculty members and part-time teachers 19 under which at least 75% of all full-time equivalent teaching 20 positions in the community college district are held by 21 full-time faculty members and not more than 25% of all 22 full-time equivalent teaching positions in the community 23 college district are held by part-time teachers; provided 24 that this subsection (b) shall not be construed to prohibit 25 job sharing of full-time positions. 26 Beginning with fiscal year 2000, and in each fiscal year 27 thereafter, a community college district shall use and apply 28 not less than 33% of the amount by which the aggregate grants 29 received by the district under Section 2-16.02 for the 30 current fiscal year exceed the aggregate grants received by 31 the district under that Section for the immediately preceding 32 fiscal year to (i) increase the number of full-time -14- LRB9100958NTsbA 1 equivalent teaching positions in the district that are held 2 by full-time faculty members and (ii) decrease the number of 3 full-time equivalent teaching positions in the district that 4 are held by part-time teachers. The requirement of using a 5 specified percentage of each fiscal year's increase in the 6 aggregate grants received by the district under Section 7 2-16.02 shall no longer apply to the district when at least 8 75% of those full-time equivalent teaching positions are held 9 by full-time faculty members and not more than 25% of those 10 full-time equivalent teaching positions are held by part-time 11 teachers. 12 (c) The State Board shall promulgate all rules necessary 13 to administer and implement the provisions of this Section. 14 Section 99. Effective date. This Act takes effect upon 15 becoming law.
