91_SB0172 LRB9100333RCks 1 AN ACT to amend the Code of Criminal Procedure of 1963 by 2 changing Section 107-14. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Code of Criminal Procedure of 1963 is 6 amended by changing Section 107-14 as follows: 7 (725 ILCS 5/107-14) (from Ch. 38, par. 107-14) 8 Sec. 107-14. Temporary questioning without arrest. 9 (a) A peace officer, after having identified himself or 10 herself as a peace officer, may stop any person in a public 11 place for a reasonable period of time when the officer 12 reasonably infers from the circumstances that the person is 13 committing, is about to commit, or has committed an offense 14 as defined in Section 102--15 of this Code, and may demand 15 the name and address of the person and an explanation of his 16 or her actions. TheSuchdetention and temporary questioning 17 will be conducted in the vicinity of where the person was 18 stopped. 19 (b) A person who, upon demand, fails to give his or her 20 name and address to a peace officer who conducts a lawful 21 stop under subsection (a) of this Section is guilty of a 22 Class B misdemeanor. 23 (Source: Laws 1968, p. 218.)
