91_SB0156 LRB9102154DHpk 1 AN ACT to amend the Shawneetown Regional Port District 2 Act by changing Section 4. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Shawneetown Regional Port District Act is 6 amended by changing Section 4 as follows: 7 (70 ILCS 1850/4) (from Ch. 19, par. 404) 8 Sec. 4. The Port District has the following rights and 9 powers: 10 1. To issue permits: for the construction of all 11 wharves, piers, dolphins, booms, weirs, breakwaters, 12 bulkheads, jetties, bridges or other structures of any kind, 13 over, under, in, or within 40 feet of any navigable waters 14 within the Port Districts; for the deposit of rock, earth, 15 sand or other material, or any matter of any kind or 16 description in thosesaidwaters; and to fix, charge, assess 17 and collect fees, annually or on any other periodic basis 18 determined by the Port District, for the maintenance, 19 extension, or continuance of any permits in the amounts the 20 Port District in its discretion considers advisable; except 21 that nothing contained in this paragraph 1 shall be construed 22 so that it will be deemed necessary to obtain a permit from 23 the District for the erection, operation or maintenance of 24 any bridge crossing a waterway which serves as a boundary 25 between the State of Illinois and any other State, when said 26 erection, operation or maintenance is performed by any city 27 within the District; 28 2. To prevent or remove obstructions in navigable 29 waters, including the removal of wrecks; 30 3. To locate and establish dock lines and shore or 31 harbor lines; -2- LRB9102154DHpk 1 4. To regulate the anchorage, moorage and speed of water 2 borne vessels and to establish and enforce regulations for 3 the operation of bridges, except nothing contained in this 4 paragraph 4 shall be construed to give the District authority 5 to regulate the operation of any bridge crossing a water-way 6 which serves as a boundary between the State of Illinois and 7 any other State, when such operation is performed or to be 8 performed by any city within the District; 9 5. To acquire, own, construct, lease, operate and 10 maintain terminals, terminal facilities and port facilities, 11 and to fix and collect just, reasonable, and 12 nondiscriminatory charges for the use of such facilities. The 13 charges so collected shall be used to defray the reasonable 14 expenses of the Port District and to pay the principal of and 15 interest on any revenue bonds issued by the District; 16 6. To locate, establish and maintain a public airport, 17 public airports and public airport facilities within its 18 corporate limits or within or upon any body of water adjacent 19 thereto, and to construct, develop, expand, extend and 20 improve any such airport or airport facility; 21 7. To operate, maintain, manage, lease, sublease, and to 22 make and enter into contracts for the use, operation or 23 management of, and to provide rules and regulations for, the 24 operation, management or use of, any public airport or public 25 airport facility; 26 8. To fix, charge and collect reasonable rentals, tolls, 27 fees, and charges for the use of any public airport, or any 28 part thereof, or any public airport facility, or any 29 terminal, port facilities, terminal facilities, or any public 30 or private wharves, piers, dolphins, booms, weirs, 31 breakwaters, bulkheads, jetties, bridges, or other structures 32 of any kind, over, under, in, or within 40 feet of any 33 navigable waters within the Port District; 34 9. To establish, maintain, extend and improve roadways -3- LRB9102154DHpk 1 and approaches by land, water or air to any such airport and 2 to contract or otherwise provide, by condemnation if 3 necessary, for the removal of any airport hazard or the 4 removal or relocation of all private structures, railways, 5 mains, pipes, conduits, wires, poles, and all other 6 facilities and equipment which may interfere with the 7 location, expansion, development, or improvement of airports 8 or with the safe approach thereto or takeoff therefrom by 9 aircraft, and to pay the cost of removal or relocation; and, 10 subject to the "Airport Zoning Act", approved July 17, 1945, 11 as amended, to adopt, administer and enforce airport zoning 12 regulations for territory which is within its corporate 13 limits or which extends not more than two miles beyond its 14 corporate limits; 15 10. To restrict the height of any object of natural 16 growth or structure or structures within the vicinity of any 17 airport or within the lines of an approach to any airport 18 and, when necessary, for the reduction in the height of any 19 such existing object or structure, to enter into an agreement 20 for such reduction or to accomplish same by condemnation; 21 11. To agree with the state or federal governments or 22 with any public agency in respect to the removal and 23 relocation of any object of natural growth, airport hazard or 24 any structure or building within the vicinity of any airport 25 or within an approach and which is owned or within the 26 control of such government or agency and to pay all or an 27 agreed portion of the cost of such removal or relocation; 28 12. For the prevention of accidents, for the furtherance 29 and protection of public health, safety and convenience in 30 respect to aeronautics, for the protection of property and 31 persons within the District from any hazard or nuisance 32 resulting from the flight of aircraft, for the prevention of 33 interference between, or collision of, aircraft while in 34 flight or upon the ground, for the prevention or abatement of -4- LRB9102154DHpk 1 nuisances in the air or upon the ground or for the extension 2 of increase in the usefulness or safety of any public airport 3 or public airport facility owned by the District, the 4 District may regulate and restrict the flight of aircraft 5 while within or above the incorporated territory of the 6 District; 7 13. To police its physical property only and all 8 waterways and to exercise police powers in respect thereto or 9 in respect to the enforcement of any rule or regulation 10 provided by the ordinances of the District and to employ and 11 commission police officers and other qualified persons to 12 enforce the same. The use of any such public airport or 13 public airport facility of the District shall be subject to 14 the reasonable regulation and control of the District and 15 upon such reasonable terms and conditions as shall be 16 established by its Board. A regulatory ordinance of the 17 District adopted under any provisions of this Section may 18 provide for a suspension or revocation of any rights or 19 privileges within the control of the District for a violation 20 of any such regulatory ordinance. Nothing in this Section or 21 in other provisions of this Act shall be construed to 22 authorize the Board to establish or enforce any regulation or 23 rule in respect to aviation, or the operation or maintenance 24 of any airport facility within its jurisdiction, which is in 25 conflict with any federal or state law or regulation 26 applicable to the same subject matter; 27 14. To enter into agreements with the corporate 28 authorities or governing body of any other municipal 29 corporation or any political subdivision of this State to pay 30 the reasonable expense of services furnished by such 31 municipal corporation or political subdivision for or on 32 account of income producing properties of the District; 33 15. To enter into contracts dealing in any manner with 34 the objects and purposes of this Act. -5- LRB9102154DHpk 1 16. To acquire, own, lease, sell or otherwise dispose of 2 interests in and to real property and improvements situate 3 thereon and in personal property necessary to fulfill the 4 purposes of the District; 5 17. To designate the fiscal year for the District. 6 18. To engage in any activity or operation which is 7 incidental to and in furtherance of efficient operation to 8 accomplish the District's primary purpose. 9 (Source: Laws 1961, p. 2975.)
