91_SB0119 LRB9100959NTks 1 AN ACT relating to university presidents and chancellors, 2 amending named Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The University of Illinois Act is amended by 6 adding Section 4.2 as follows: 7 (110 ILCS 305/4.2 new) 8 Sec. 4.2. Private sector service; compensation 9 prohibited. 10 (a) No person who is employed as the President or as a 11 chancellor of the University of Illinois may contract for or 12 accept any payment of money or other thing of value or 13 economic benefit as an honorarium, per diem, salary, or other 14 form of compensation in return for his or her service as an 15 officer, director, trustee, or other member of the governing 16 or executive board of a private, for-profit or not-for-profit 17 association, foundation, business trust, corporation, or 18 other business entity located or doing business in Illinois 19 or in any other state. 20 (b) The President or chancellor shall not be deemed to 21 have accepted a payment of money or other thing of value or 22 economic benefit from an entity described in subsection (a) 23 in violation of that subsection if that entity pays for, or 24 reimburses the President or chancellor who pays for, the 25 reasonable travel, lodging, and meal expenses that are 26 actually and necessarily incurred by the President or 27 chancellor in order to attend a regular meeting of the 28 governing or executive board of that entity. 29 (c) If the President or a chancellor accepts a payment 30 of money or other thing of value or economic benefit in 31 violation of subsection (a): (i) the same shall be -2- LRB9100959NTks 1 surrendered by the President or chancellor to the State 2 Treasurer and deposited into the General Revenue Fund or 3 otherwise held for the use and benefit of the State; and (ii) 4 the employment of the President or chancellor shall be 5 terminated by the board of trustees of the University of 6 Illinois unless the President or chancellor establishes good 7 cause why his or her employment should not be terminated. 8 Section 10. The Southern Illinois University Management 9 Act is amended by adding Section 8.1 as follows: 10 (110 ILCS 520/8.1 new) 11 Sec. 8.1. Private sector service; compensation 12 prohibited. 13 (a) No person who is employed as the President or as a 14 chancellor of Southern Illinois University may contract for 15 or accept any payment of money or other thing of value or 16 economic benefit as an honorarium, per diem, salary, or other 17 form of compensation in return for his or her service as an 18 officer, director, trustee, or other member of the governing 19 or executive board of a private, for-profit or not-for-profit 20 association, foundation, business trust, corporation, or 21 other business entity located or doing business in Illinois 22 or in any other state. 23 (b) The President or chancellor shall not be deemed to 24 have accepted a payment of money or other thing of value or 25 economic benefit from an entity described in subsection (a) 26 in violation of that subsection if that entity pays for, or 27 reimburses the President or chancellor who pays for, the 28 reasonable travel, lodging, and meal expenses that are 29 actually and necessarily incurred by the President or 30 chancellor in order to attend a regular meeting of the 31 governing or executive board of that entity. 32 (c) If the President or a chancellor accepts a payment -3- LRB9100959NTks 1 of money or other thing of value or economic benefit in 2 violation of subsection (a): (i) the same shall be 3 surrendered by the President or chancellor to the State 4 Treasurer and deposited into the General Revenue Fund or 5 otherwise held for the use and benefit of the State; and (ii) 6 the employment of the President or chancellor shall be 7 terminated by the board of trustees of Southern Illinois 8 University unless the President or chancellor establishes 9 good cause why his or her employment should not be 10 terminated. 11 Section 15. The Chicago State University Law is amended 12 by adding Section 5-46 as follows: 13 (110 ILCS 660/5-46 new) 14 Sec. 5-46. Private sector service; compensation 15 prohibited. 16 (a) No person who is employed as the President or as a 17 chancellor of Chicago State University may contract for or 18 accept any payment of money or other thing of value or 19 economic benefit as an honorarium, per diem, salary, or other 20 form of compensation in return for his or her service as an 21 officer, director, trustee, or other member of the governing 22 or executive board of a private, for-profit or not-for-profit 23 association, foundation, business trust, corporation, or 24 other business entity located or doing business in Illinois 25 or in any other state. 26 (b) The President or chancellor shall not be deemed to 27 have accepted a payment of money or other thing of value or 28 economic benefit from an entity described in subsection (a) 29 in violation of that subsection if that entity pays for, or 30 reimburses the President or chancellor who pays for, the 31 reasonable travel, lodging, and meal expenses that are 32 actually and necessarily incurred by the President or -4- LRB9100959NTks 1 chancellor in order to attend a regular meeting of the 2 governing or executive board of that entity. 3 (c) If the President or a chancellor accepts a payment 4 of money or other thing of value or economic benefit in 5 violation of subsection (a): (i) the same shall be 6 surrendered by the President or chancellor to the State 7 Treasurer and deposited into the General Revenue Fund or 8 otherwise held for the use and benefit of the State; and (ii) 9 the employment of the President or chancellor shall be 10 terminated by the board of trustees of Chicago State 11 University unless the President or chancellor establishes 12 good cause why his or her employment should not be 13 terminated. 14 Section 20. The Eastern Illinois University Law is 15 amended by adding Section 10-46 as follows: 16 (110 ILCS 665/10-46 new) 17 Sec. 10-46. Private sector service; compensation 18 prohibited. 19 (a) No person who is employed as the President or as a 20 chancellor of Eastern Illinois University may contract for or 21 accept any payment of money or other thing of value or 22 economic benefit as an honorarium, per diem, salary, or other 23 form of compensation in return for his or her service as an 24 officer, director, trustee, or other member of the governing 25 or executive board of a private, for-profit or not-for-profit 26 association, foundation, business trust, corporation, or 27 other business entity located or doing business in Illinois 28 or in any other state. 29 (b) The President or chancellor shall not be deemed to 30 have accepted a payment of money or other thing of value or 31 economic benefit from an entity described in subsection (a) 32 in violation of that subsection if that entity pays for, or -5- LRB9100959NTks 1 reimburses the President or chancellor who pays for, the 2 reasonable travel, lodging, and meal expenses that are 3 actually and necessarily incurred by the President or 4 chancellor in order to attend a regular meeting of the 5 governing or executive board of that entity. 6 (c) If the President or a chancellor accepts a payment 7 of money or other thing of value or economic benefit in 8 violation of subsection (a): (i) the same shall be 9 surrendered by the President or chancellor to the State 10 Treasurer and deposited into the General Revenue Fund or 11 otherwise held for the use and benefit of the State; and (ii) 12 the employment of the President or chancellor shall be 13 terminated by the board of trustees of Eastern Illinois 14 University unless the President or chancellor establishes 15 good cause why his or her employment should not be 16 terminated. 17 Section 25. The Governors State University Law is 18 amended by adding Section 15-46 as follows: 19 (110 ILCS 670/15-46 new) 20 Sec. 15-46. Private sector service; compensation 21 prohibited. 22 (a) No person who is employed as the President or as a 23 chancellor of Governors State University may contract for or 24 accept any payment of money or other thing of value or 25 economic benefit as an honorarium, per diem, salary, or other 26 form of compensation in return for his or her service as an 27 officer, director, trustee, or other member of the governing 28 or executive board of a private, for-profit or not-for-profit 29 association, foundation, business trust, corporation, or 30 other business entity located or doing business in Illinois 31 or in any other state. 32 (b) The President or chancellor shall not be deemed to -6- LRB9100959NTks 1 have accepted a payment of money or other thing of value or 2 economic benefit from an entity described in subsection (a) 3 in violation of that subsection if that entity pays for, or 4 reimburses the President or chancellor who pays for, the 5 reasonable travel, lodging, and meal expenses that are 6 actually and necessarily incurred by the President or 7 chancellor in order to attend a regular meeting of the 8 governing or executive board of that entity. 9 (c) If the President or a chancellor accepts a payment 10 of money or other thing of value or economic benefit in 11 violation of subsection (a): (i) the same shall be 12 surrendered by the President or chancellor to the State 13 Treasurer and deposited into the General Revenue Fund or 14 otherwise held for the use and benefit of the State; and (ii) 15 the employment of the President or chancellor shall be 16 terminated by the board of trustees of Governors State 17 University unless the President or chancellor establishes 18 good cause why his or her employment should not be 19 terminated. 20 Section 30. The Illinois State University Law is amended 21 by adding Section 20-46 as follows: 22 (110 ILCS 675/20-46 new) 23 Sec. 20-46. Private sector service; compensation 24 prohibited. 25 (a) No person who is employed as the President or as a 26 chancellor of Illinois State University may contract for or 27 accept any payment of money or other thing of value or 28 economic benefit as an honorarium, per diem, salary, or other 29 form of compensation in return for his or her service as an 30 officer, director, trustee, or other member of the governing 31 or executive board of a private, for-profit or not-for-profit 32 association, foundation, business trust, corporation, or -7- LRB9100959NTks 1 other business entity located or doing business in Illinois 2 or in any other state. 3 (b) The President or chancellor shall not be deemed to 4 have accepted a payment of money or other thing of value or 5 economic benefit from an entity described in subsection (a) 6 in violation of that subsection if that entity pays for, or 7 reimburses the President or chancellor who pays for, the 8 reasonable travel, lodging, and meal expenses that are 9 actually and necessarily incurred by the President or 10 chancellor in order to attend a regular meeting of the 11 governing or executive board of that entity. 12 (c) If the President or a chancellor accepts a payment 13 of money or other thing of value or economic benefit in 14 violation of subsection (a): (i) the same shall be 15 surrendered by the President or chancellor to the State 16 Treasurer and deposited into the General Revenue Fund or 17 otherwise held for the use and benefit of the State; and (ii) 18 the employment of the President or chancellor shall be 19 terminated by the board of trustees of Illinois State 20 University unless the President or chancellor establishes 21 good cause why his or her employment should not be 22 terminated. 23 Section 35. The Northeastern Illinois University Law is 24 amended by adding Section 25-46 as follows: 25 (110 ILCS 680/25-46 new) 26 Sec. 25-46. Private sector service; compensation 27 prohibited. 28 (a) No person who is employed as the President or as a 29 chancellor of Northeastern Illinois University may contract 30 for or accept any payment of money or other thing of value or 31 economic benefit as an honorarium, per diem, salary, or other 32 form of compensation in return for his or her service as an -8- LRB9100959NTks 1 officer, director, trustee, or other member of the governing 2 or executive board of a private, for-profit or not-for-profit 3 association, foundation, business trust, corporation, or 4 other business entity located or doing business in Illinois 5 or in any other state. 6 (b) The President or chancellor shall not be deemed to 7 have accepted a payment of money or other thing of value or 8 economic benefit from an entity described in subsection (a) 9 in violation of that subsection if that entity pays for, or 10 reimburses the President or chancellor who pays for, the 11 reasonable travel, lodging, and meal expenses that are 12 actually and necessarily incurred by the President or 13 chancellor in order to attend a regular meeting of the 14 governing or executive board of that entity. 15 (c) If the President or a chancellor accepts a payment 16 of money or other thing of value or economic benefit in 17 violation of subsection (a): (i) the same shall be 18 surrendered by the President or chancellor to the State 19 Treasurer and deposited into the General Revenue Fund or 20 otherwise held for the use and benefit of the State; and (ii) 21 the employment of the President or chancellor shall be 22 terminated by the board of trustees of Northeastern Illinois 23 University unless the President or chancellor establishes 24 good cause why his or her employment should not be 25 terminated. 26 Section 40. The Northern Illinois University Law is 27 amended by adding Section 30-46 as follows: 28 (110 ILCS 685/30-46 new) 29 Sec. 30-46. Private sector service; compensation 30 prohibited. 31 (a) No person who is employed as the President or as a 32 chancellor of Northern Illinois University may contract for -9- LRB9100959NTks 1 or accept any payment of money or other thing of value or 2 economic benefit as an honorarium, per diem, salary, or other 3 form of compensation in return for his or her service as an 4 officer, director, trustee, or other member of the governing 5 or executive board of a private, for-profit or not-for-profit 6 association, foundation, business trust, corporation, or 7 other business entity located or doing business in Illinois 8 or in any other state. 9 (b) The President or chancellor shall not be deemed to 10 have accepted a payment of money or other thing of value or 11 economic benefit from an entity described in subsection (a) 12 in violation of that subsection if that entity pays for, or 13 reimburses the President or chancellor who pays for, the 14 reasonable travel, lodging, and meal expenses that are 15 actually and necessarily incurred by the President or 16 chancellor in order to attend a regular meeting of the 17 governing or executive board of that entity. 18 (c) If the President or a chancellor accepts a payment 19 of money or other thing of value or economic benefit in 20 violation of subsection (a): (i) the same shall be 21 surrendered by the President or chancellor to the State 22 Treasurer and deposited into the General Revenue Fund or 23 otherwise held for the use and benefit of the State; and (ii) 24 the employment of the President or chancellor shall be 25 terminated by the board of trustees of Northern Illinois 26 University unless the President or chancellor establishes 27 good cause why his or her employment should not be 28 terminated. 29 Section 45. The Western Illinois University Law is 30 amended by adding Section 35-46 as follows: 31 (110 ILCS 690/35-46 new) 32 Sec. 35-46. Private sector service; compensation -10- LRB9100959NTks 1 prohibited. 2 (a) No person who is employed as the President or as a 3 chancellor of Western Illinois University may contract for or 4 accept any payment of money or other thing of value or 5 economic benefit as an honorarium, per diem, salary, or other 6 form of compensation in return for his or her service as an 7 officer, director, trustee, or other member of the governing 8 or executive board of a private, for-profit or not-for-profit 9 association, foundation, business trust, corporation, or 10 other business entity located or doing business in Illinois 11 or in any other state. 12 (b) The President or chancellor shall not be deemed to 13 have accepted a payment of money or other thing of value or 14 economic benefit from an entity described in subsection (a) 15 in violation of that subsection if that entity pays for, or 16 reimburses the President or chancellor who pays for, the 17 reasonable travel, lodging, and meal expenses that are 18 actually and necessarily incurred by the President or 19 chancellor in order to attend a regular meeting of the 20 governing or executive board of that entity. 21 (c) If the President or a chancellor accepts a payment 22 of money or other thing of value or economic benefit in 23 violation of subsection (a): (i) the same shall be 24 surrendered by the President or chancellor to the State 25 Treasurer and deposited into the General Revenue Fund or 26 otherwise held for the use and benefit of the State; and (ii) 27 the employment of the President or chancellor shall be 28 terminated by the board of trustees of Western Illinois 29 University unless the President or chancellor establishes 30 good cause why his or her employment should not be 31 terminated. 32 Section 99. Effective date. This Act takes effect upon 33 becoming law.
