Amend Senate Bill 94 on page 1, 3 lines 2 and 6, by inserting after "Section 1" wherever it 4 appears "and adding Section 0.02"; and 5 on page 1, by inserting between lines 6 and 7 the following: 6 "(720 ILCS 135/0.02 new) 7 Sec. 0.02. Person defined. For the purposes of this 8 Act, the term "person" is not intended to refer to a 9 telecommunications carrier as defined in Section 13-202 of 10 the Public Utilities Act or a provider of access to the 11 internet where internet refers to the global information 12 system that is logically linked together by a globally unique 13 address space based on the Internet Protocol or its 14 subsequent extensions/follow-ons and is able to support 15 communications using the Transmission Control 16 Protocol/Internet Protocol suite or its subsequent 17 extensions/follow-ons, and/or other Internet 18 Protocol-compatible protocols."; and 19 on page 1, by replacing lines 20 through 31 with the 20 following: 21 "(b) Any person 17 years of age or older in this State 22 who, with the intent to offend, sends any communications or -2- LRB9101683RCksam 1 messages or uses language or terms that purport to solicit a 2 sexual act with a person, knowing the person to be under 13 3 years of age, by means of or while using any electronic 4 communication, a telephone or equipment, or wires or by means 5 of any electronic communication of any person, firm, or 6 corporation engaged in the transmission of news or messages 7 between states or within this State is guilty of a Class 4 8 felony. 9 (c) For the purposes of this Section, "sexual act" means 10 any act of sexual penetration as defined in subsection (f) of 11 Section 12-12 of the".
