1 AN ACT to amend the Consumer Fraud and Deceptive Business
2 Practices Act by adding Section 2JJ.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Consumer Fraud and Deceptive Business
6 Practices Act is amended by adding Section 2JJ as follows:
7 (815 ILCS 505/2JJ new)
8 Sec. 2JJ. Shoppers club information.
9 (a) It is an unlawful practice for any person who is an
10 officer, manager, or employee of a retail mercantile
11 establishment to sell, give, or permit access by a person who
12 is not an officer, manager, or employee of the retail
13 mercantile establishment to any information contained in an
14 application for a shoppers club membership or information
15 concerning purchases of merchandise with a shoppers club card
16 without the consent of the applicant or member.
17 (b) For the purposes of this Section:
18 "Merchandise" means any item of tangible personal
19 property.
20 "Retail mercantile establishment" means any place where
21 merchandise is sold or offered for sale at retail to the
22 public or to persons who are members of the shopper's club.
23 "Shoppers club" means a membership in a discount buying
24 program in which the purchaser is given a reduction in the
25 price of the merchandise by displaying a card that when used
26 with an electronic scanning device or sales recording device
27 at the time of the purchase of the merchandise displays the
28 discount price of the merchandise.
