91_SB0065 LRB9100909EGfg 1 AN ACT to amend the Illinois Pension Code by changing 2 Sections 5-178 and 5-179. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Illinois Pension Code is amended by 6 changing Sections 5-178 and 5-179 as follows: 7 (40 ILCS 5/5-178) (from Ch. 108 1/2, par. 5-178) 8 Sec. 5-178. Board created. A board of 8 members shall 9 constitute a board of trustees authorized to administer the 10 provisions of this Article. The board shall be known as the 11 Retirement Board of the Policemen's Annuity and Benefit Fund 12 of the city. 13 The board shall consist of 4 persons appointed by the 14 mayor of the city; 3 policemen employed by the city, at least 15 one of whom shall be a lieutenant or of a rank superior to 16 lieutenant, one of whom shall be of the rank of sergeant, and 17 one of whom shall be of the rank of investigator or a rank 18 inferior to that rank; and one annuitant of the fund, or a 19 pensioner of any prior police pension fund in operation, by 20 authority of law, in the city. Children less than age 18 21 shall not be eligible for board membership. The term of 22 office for all members shall be 3 years. Uponhiselection, 23 anythemember holding the rank of investigator or a rank 24 inferior to that rank shall be detailed by the Police 25 Superintendent to the office of the board for the duration of 26 his or her term as trustee. 27The members of a retirement board holding office in a28city at the time this Article becomes effective, including29elected, appointed and ex-officio members, shall continue in30office until the expiration of their respective terms or31appointment and until their respective successors are elected-2- LRB9100909EGfg 1or appointed, and qualified.2 At least 30 days prior to the expiration of the term of 3 office of each appointive member the mayor shall appoint a 4 successor for a term of 3 years. 5 The board shall conduct a regular election at least 30 6 days prior to the expiration of the term of each elected 7 member, to elect that member's successorterms of the active8policemen members and annuitant or beneficiary members for9election of a successor of each such member for a term of 310years. 11 Any member of the board so appointed or elected shall 12 continue in office until ahissuccessor is selected and has 13 qualified. 14 Any person so appointed or elected shall qualify by 15 taking an oath of office. The regular elections for 20 members of the board shall be held under rules of the board 21 at least 30 days prior to the expiration of the term of 22 office of any elective member. 23 At any election for active policemen members, allsuch24 policemenof the appropriate rankemployed by the city when 25 the election is held have a right to vote for all active 26 police officer positions on the board, regardless of rankfor27members of the board of the same class of rank. 28 At any election for the pensioner or annuitant member, 29 all annuitants and pensioners (except children less than age 30 18) and the legal guardian of any child annuitant or child 31 pensioner, whose mother or stepmother is not an annuitant or 32 pensioner of the fund, shall have a right to vote. 33 Ballots to be cast in such elections shall be of a secret -3- LRB9100909EGfg 1 character. 2 (Source: P.A. 80-671.) 3 Section 99.
