 1        AN ACT to amend the Illinois  Pension  Code  by  changing
 2    Section 5-178.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The  Illinois  Pension  Code  is  amended  by
 6    changing Section 5-178 as follows:

 7        (40 ILCS 5/5-178) (from Ch. 108 1/2, par. 5-178)
 8        Sec.  5-178.  Board  created.   A  board  of 10 members 8
 9    members shall constitute a board of  trustees  authorized  to
10    administer  the  provisions of this Article.  The board shall
11    be known as the Retirement Board of the  Policemen's  Annuity
12    and Benefit Fund of the city.
13        The  board shall consist of the city clerk, ex officio; 4
14    persons appointed by the mayor of the  city;  4  policemen  3
15    policemen employed by the city, at least one of whom shall be
16    a lieutenant or of a rank superior to lieutenant, one of whom
17    shall  be of the rank of sergeant, and 2 of one of whom shall
18    be of the rank of investigator or a  rank  inferior  to  that
19    rank;  and  one  annuitant of the fund, or a pensioner of any
20    prior police pension fund in operation, by authority of  law,
21    in the city.  Children less than age 18 shall not be eligible
22    for  board  membership.   The  term of office for all members
23    shall be 3 years.  Upon his election, any the member  holding
24    the  rank  of  investigator  or  a rank inferior to that rank
25    shall be detailed by the Police Superintendent to the  office
26    of the board for the duration of his or her term as trustee.
27        The  members  of  a  retirement board holding office in a
28    city at the time this Article  becomes  effective,  including
29    elected,  appointed and ex-officio members, shall continue in
30    office until the expiration  of  their  respective  terms  or
31    appointment and until their respective successors are elected

 1    or appointed, and qualified.
 2        At  least  30 days prior to the expiration of the term of
 3    office of each appointive member the mayor  shall  appoint  a
 4    successor for a term of 3 years.
 5        The  board  shall  conduct a regular election at least 30
 6    days prior to the expiration of  the  term  of  each  elected
 7    member,  to elect that member's successor terms of the active
 8    policemen members and annuitant or  beneficiary  members  for
 9    election  of  a successor of each such member for a term of 3
10    years.  The additional active  policeman  member  created  by
11    this  amendatory Act of the 91st General Assembly shall first
12    be elected as provided in Section 5-180 for  the  filling  of
13    vacancies.
14        Any  member  of  the  board so appointed or elected shall
15    continue in office until a his successor is selected and  has
16    qualified.
17        Any  person  so  appointed  or  elected  shall qualify by
18    taking an oath of office.  A copy thereof shall  be  kept  in
19    the office of the city clerk of the city.

21        Section  99.  Effective date.  This Act takes effect upon
22    becoming law.
