91_SB0017enr SB17 Enrolled LRB9100542NTmb 1 AN ACT to amend the School Code by changing Section 2 2-3.12a. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. If and only if a bill of the 90th General 6 Assembly that amends the School Code by adding Section 7 2-3.12a becomes law, the School Code is amended by changing 8 Section 2-3.12a as follows: 9 (105 ILCS 5/2-3.12a) 10 Sec. 2-3.12a. Health/Life Safety Code Advisory 11 Committee. 12 (a) The Health/Life Safety Code Advisory Committee is 13 created. The Committee shall be composed of 11 members. The 14 President of the Senate, the Minority Leader of the Senate, 15 the Speaker of the House of Representatives, and the Minority 16 Leader of the House of Representatives shall appoint one 17 member each, the Governor shall appoint 4 members, and the 18 State Superintendent of Education shall appoint 3 members. 19 At least one member appointed by the Governor shall have 20 resided within a large unit school district for at least 5 21 years preceding the appointment. For the purposes of this 22 Section, a "large unit school district" means a grades K 23 through 12 district with a student enrollment of 3,500 or 24 more. All appointments to the Committee shall be made within 25 15 days after the effective date of this amendatory Act of 26 1998. Members of the Committee shall serve without 27 compensation but shall be reimbursed for their reasonable and 28 necessary expenses from funds appropriated for that purpose. 29 The Committee shall hold an organizational meeting within 10 30 days after the last member has been appointed. The Committee 31 shall select one member as chairperson at this organizational SB17 Enrolled -2- LRB9100542NTmb 1 meeting. A majority of the members shall constitute a 2 quorum. 3 (b) The Committee shall review the establishment and 4 enforcement of life safety rules and requirements and the 5 categorization of life safety items as "urgent" or "required" 6 in safety survey reports, as set forth in Section 2-3.12 of 7 this Code and pursuant to the rules and procedures 8 promulgated by the State Board of Education in the 9 Health/Life Safety Code for Public Schools. In particular, 10 the Committee shall (i) review the process by which items are 11 designated as "urgent" or "required" life safety items and 12 inquire into the classification of life safety items as 13 "urgent" or "required", (ii) review the rules and procedures, 14 including the procedures for appeal and review of safety 15 survey reports and recommendations issued by the State 16 Superintendent of Education pursuant to the safety survey 17 reports, established for compelling, obtaining, and 18 implementing remedial construction and retrofitting of 19 school-related property and buildings mandated under the 20 school building code, known as the Health/Life Safety Code 21 for Public Schools, (iii) inquire into and identify budgetary 22 and other problems, difficulties, and matters of controversy 23 that are associated with the conducting of school safety 24 surveys, and (iv) inquire into the enforcement of the 25 Health/Life Safety Code for Public Schools. The Committee 26 shall report its findings and recommendations to the General 27 Assembly, the Governor, and the State Superintendent of 28 Education by September 1,April 15,1999. The report shall 29 contain recommendations to remedy problems, difficulties, and 30 matters of controversy identified in the report, including 31 those related to the definition and classification of life 32 safety items as "urgent" or "required". 33 (c) This Section is repealed on December 31,May 1,34 1999.
