91_SB0012enr SB12 Enrolled LRB9101028MWtm 1 AN ACT to amend the Public Water District Act by changing 2 Section 26. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Water District Act is amended by 6 changing Section 26 as follows: 7 (70 ILCS 3705/26) (from Ch. 111 2/3, par. 212.1) 8 Sec. 26. Annexation. Any territory which is contiguous to 9 a public water district organized under this Act and which is 10 not included in any public water district may be annexed to 11 such contiguous public water district in the manner provided 12 by this Section. 13 A petition, signed by two-thirds of the legal voters 14 residing in the territory sought to be annexed, or if there 15 are no legal voters in the territory, a majority of the 16 owners of record of the land in the territory, and addressed 17 to the circuit court of the county in which the public water 18 district to which annexation is sought was organized, 19 requesting that the territory described in the petition be 20 annexed to such public water district, may be filed with the 21 clerk of such court. The clerk of such court shall thereupon 22 present such petition to the court which shall set a time, 23 place and date for a hearing thereon, which date shall be not 24 less than 20 nor more than 45 days after the date the 25 petition was filed. The court shall give notice of the time, 26 place and date of the hearing by publication in one or more 27 newspapers published in the district, and if there is no such 28 newspaper, in one or more newspapers published in the county 29 and having a general circulation within the public water 30 district and within the territory sought to be annexed 31 thereto, which publication shall be made at least 15 days SB12 Enrolled -2- LRB9101028MWtm 1 prior to the date set for the hearing. 2 (Source: P.A. 83-532.) 3 Section 99.
