91_HB4698enr HB4698 Enrolled LRB9113245NTks 1 AN ACT concerning public and appellate defender immunity. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Public and Appellate Defender Immunity Act. 6 Section 5. Immunity. No public defender, assistant 7 public defender, appellate defender, or assistant appellate 8 defender, acting within the scope of his or her employment or 9 contract, nor any person or entity employing, supervising, 10 assisting, or contracting for the services of a public 11 defender, assistant public defender, appellate defender, or 12 assistant appellate defender, is liable for any damages in 13 tort, contract, or otherwise, in which the plaintiff seeks 14 damages by reason of legal or professional malpractice, 15 except for willful and wanton misconduct. 16 Section 99. Effective date. This Act takes effect upon 17 becoming law.
