91_HB4622 LRB9111283RCpr 1 AN ACT to amend the Criminal Code of 1961 by changing 2 Section 26-4. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 changing Section 26-4 as follows: 7 (720 ILCS 5/26-4) (from Ch. 38, par. 26-4) 8 Sec. 26-4. Unauthorized videotaping. 9 (a) It is unlawful for any person to videotape, 10 photograph, or film another person without that person's 11 consent in a restroom, tanning bed, or tanning salon. 12 (a-5) It is unlawful for any person to disseminate on 13 the Internet any images of another person in a restroom 14 without that other person's consent. For purposes of this 15 subsection (a-5), "Internet" includes the World Wide Web, 16 electronic mail, a news group posting, or Internet file 17 transfer. 18 (b) Exemptions. The following activities shall be 19 exempt from the provisions of this Section: 20 (1) Videotaping, photographing, and filming by law 21 enforcement officers pursuant to a criminal 22 investigation, which is otherwise lawful; 23 (2) Videotaping, photographing, and filming by 24 correctional officials for security reasons or for 25 investigation of alleged misconduct involving a person 26 committed to the Department of Corrections. 27 (c) The provisions of this Section do not apply to any 28 sound recording of an oral conversation made as the result of 29 the videotaping or filming, and to which Article 14 of this 30 Code applies. 31 (d) Sentence.
