Amend House Bill 4611 as follows: 3 by replacing the title of the bill with the following: 4 "AN ACT to amend the Illinois Public Aid Code by adding 5 Section 12-13.3."; and 6 by replacing everything after the enacting clause with the 7 following: 8 "Section 5. The Illinois Public Aid Code is amended by 9 adding Section 12-13.3 as follows: 10 (305 ILCS 5/12-13.3 new) 11 Sec. 12-13.3. W-2 statements for obligors; pilot program. 12 (a) In this Section: 13 "Department" means the Illinois Department of Public Aid. 14 "Obligor" and "obligee" have the meanings ascribed to 15 those terms in the Income Withholding for Support Act. 16 (b) The Department shall establish and administer a pilot 17 program as described in this Section. The Department shall 18 establish the pilot program in 5 counties as follows: 19 (1) Cook County. 20 (2) Two counties with a population of at least -2- LRB9111860DJcdam02 1 650,000 but less than 2,000,000. 2 (3) Two counties with a population less than 3 650,000. 4 A county may apply to participate in the pilot program in 5 the manner and form designated by the Department. The 6 Department shall establish criteria for selecting counties to 7 participate in the pilot program. 8 (c) Under the pilot program, every employer that 9 withholds income from an obligor in any of years 2000 through 10 2003 for the payment of amounts owed under an order for the 11 support of a child shall send to the clerk of the circuit 12 court in the county in which the order was entered a copy of 13 the Form W-2 Wage and Tax Statement furnished by the employer 14 to the obligor for each such year. The employer shall send 15 the Form W-2 to the clerk if the obligor's income is withheld 16 pursuant to the Income Withholding for Support Act. The 17 employer shall send the Form W-2 to the clerk not later than 18 January 31 of the year after the year covered by the Form 19 W-2. 20 (d) Whenever a clerk of the circuit court receives a Form 21 W-2 from an employer as provided in this Section, the clerk 22 shall immediately send a copy of the Form W-2 to the obligor 23 and a copy to the appropriate obligee. 24 (e) The Department shall adopt rules necessary to 25 implement this Section. 26 (f) The Department shall report its findings and 27 recommendations concerning the operation of the pilot program 28 to the Governor and the General Assembly by March 1, 2004. 29 Section 99. Effective date. This Act takes effect upon 30 becoming law.".
