91_HB4430 LRB9109084LDmbA 1 AN ACT in relation to gambling, amending named Acts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 3. The Electronic Fund Transfer Act is amended 5 by adding Section 98 as follows: 6 (205 ILCS 616/98 new) 7 Sec. 98. Prohibition of terminals near gambling 8 locations. No financial institution shall install or operate 9 a terminal that accepts or dispenses cash in connection with 10 a credit, deposit, or convenience account within 1,000 feet 11 of any racetrack or inter-track wagering facility licensed 12 under the Illinois Horse Racing Act of 1975 or within 1,000 13 feet of the dock of any riverboat licensed under the 14 Riverboat Gambling Act. 15 Section 5. The Illinois Horse Racing Act of 1975 is 16 amended by adding Section 34.2 as follows: 17 (230 ILCS 5/34.2 new) 18 Sec. 34.2. Prohibition against automated teller 19 machines. 20 (a) An organization licensee shall not engage in or 21 authorize the installation or operation of an automated 22 teller machine at its race track or on the grounds of any of 23 its inter-track wagering facilities. 24 (b) For the purpose of this Section, the term "automated 25 teller machine" has the same meaning as in the Automated 26 Teller Machine Security Act. 27 (c) A violation of this Section is a Class C 28 misdemeanor. -2- LRB9109084LDmbA 1 Section 10. The Riverboat Gambling Act is amended by 2 adding Section 13.2 and changing Section 18 as follows: 3 (230 ILCS 10/13.2 new)) 4 Sec. 13.2. Prohibition against automated teller 5 machines. 6 (a) An owners licensee shall not engage in or authorize 7 the installation or operation of an automated teller machine 8 on board its riverboat or on its dock. 9 (b) For the purpose of this Section, the term "automated 10 teller machine" has the same meaning as in the Automated 11 Teller Machine Security Act. 12 (230 ILCS 10/18) (from Ch. 120, par. 2418) 13 Sec. 18. Prohibited Activities - Penalty. 14 (a) A person is guilty of a Class A misdemeanor for 15 doing any of the following: 16 (1) Conducting gambling where wagering is used or 17 to be used without a license issued by the Board. 18 (2) Conducting gambling where wagering is permitted 19 other than in the manner specified by Section 11. 20 (b) A person is guilty of a Class B misdemeanor for 21 doing any of the following: 22 (1) permitting a person under 21 years to make a 23 wager; or 24 (2) violating paragraph (12) of subsection (a) of 25 Section 11 of this Act. 26 (b-1) A person is guilty of a Class C misdemeanor for 27 violating Section 13.2 of this Act. 28 (c) A person wagering or accepting a wager at any 29 location outside the riverboat is subject to the penalties in 30 paragraphs (1) or (2) of subsection (a) of Section 28-1 of 31 the Criminal Code of 1961. 32 (d) A person commits a Class 4 felony and, in addition, -3- LRB9109084LDmbA 1 shall be barred for life from riverboats under the 2 jurisdiction of the Board, if the person does any of the 3 following: 4 (1) Offers, promises, or gives anything of value or 5 benefit to a person who is connected with a riverboat 6 owner including, but not limited to, an officer or 7 employee of a licensed owner or holder of an occupational 8 license pursuant to an agreement or arrangement or with 9 the intent that the promise or thing of value or benefit 10 will influence the actions of the person to whom the 11 offer, promise, or gift was made in order to affect or 12 attempt to affect the outcome of a gambling game, or to 13 influence official action of a member of the Board. 14 (2) Solicits or knowingly accepts or receives a 15 promise of anything of value or benefit while the person 16 is connected with a riverboat including, but not limited 17 to, an officer or employee of a licensed owner, or holder 18 of an occupational license, pursuant to an understanding 19 or arrangement or with the intent that the promise or 20 thing of value or benefit will influence the actions of 21 the person to affect or attempt to affect the outcome of 22 a gambling game, or to influence official action of a 23 member of the Board. 24 (3) Uses or possesses with the intent to use a 25 device to assist: 26 (i) In projecting the outcome of the game. 27 (ii) In keeping track of the cards played. 28 (iii) In analyzing the probability of the 29 occurrence of an event relating to the gambling 30 game. 31 (iv) In analyzing the strategy for playing or 32 betting to be used in the game except as permitted 33 by the Board. 34 (4) Cheats at a gambling game. -4- LRB9109084LDmbA 1 (5) Manufactures, sells, or distributes any cards, 2 chips, dice, game or device which is intended to be used 3 to violate any provision of this Act. 4 (6) Alters or misrepresents the outcome of a 5 gambling game on which wagers have been made after the 6 outcome is made sure but before it is revealed to the 7 players. 8 (7) Places a bet after acquiring knowledge, not 9 available to all players, of the outcome of the gambling 10 game which is subject of the bet or to aid a person in 11 acquiring the knowledge for the purpose of placing a bet 12 contingent on that outcome. 13 (8) Claims, collects, or takes, or attempts to 14 claim, collect, or take, money or anything of value in or 15 from the gambling games, with intent to defraud, without 16 having made a wager contingent on winning a gambling 17 game, or claims, collects, or takes an amount of money or 18 thing of value of greater value than the amount won. 19 (9) Uses counterfeit chips or tokens in a gambling 20 game. 21 (10) Possesses any key or device designed for the 22 purpose of opening, entering, or affecting the operation 23 of a gambling game, drop box, or an electronic or 24 mechanical device connected with the gambling game or for 25 removing coins, tokens, chips or other contents of a 26 gambling game. This paragraph (10) does not apply to a 27 gambling licensee or employee of a gambling licensee 28 acting in furtherance of the employee's employment. 29 (e) The possession of more than one of the devices 30 described in subsection (d), paragraphs (3), (5) or (10) 31 permits a rebuttable presumption that the possessor intended 32 to use the devices for cheating. 33 An action to prosecute any crime occurring on a riverboat 34 shall be tried in the county of the dock at which the -5- LRB9109084LDmbA 1 riverboat is based. 2 (Source: P.A. 91-40, eff. 6-25-99.) 3 Section 99. Effective date. This Act takes effect upon 4 becoming law.
