1 AN ACT to amend the Illinois Marriage and Dissolution Act
2 by changing Section 105.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Marriage and Dissolution of
6 Marriage Act is amended by changing Section 105 as follows:
7 (750 ILCS 5/105) (from Ch. 40, par. 105)
8 Sec. 105. Application of Civil Practice Law.) (a) The
9 provisions of the Civil Practice Law shall apply to all
10 proceedings under this Act, except as otherwise provided in
11 this Act.
12 (b) A proceeding for dissolution of marriage, legal
13 separation or declaration of invalidity of marriage shall be
14 entitled "In re the Marriage of ... and ...". A custody or
15 support proceeding shall be entitled "In re the (Custody)
16 (Support) of ...".
17 (c) The initial pleading in all proceedings under this
18 Act shall be denominated a petition. A responsive pleading
19 shall be denominated a response. All other pleadings under
20 this Act shall be denominated as provided in the Civil
21 Practice Law.
