91_HB4260 LRB9110642DHmb 1 AN ACT to amend the Toll Highway Act by changing Section 2 23. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Toll Highway Act is amended by changing 6 Section 23 as follows: 7 (605 ILCS 10/23) (from Ch. 121, par. 100-23) 8 Sec. 23. (a) The Authority shall file with the Governor, 9 the Clerk of the House of Representatives, the Secretary of 10 the Senate, and the Illinois Economic and Fiscal Commission, 11 on or prior to March 15th of each year, a written statement 12 and report covering its activities for the preceding calendar 13 year. 14 (b) The Authority shall present, to the committees of 15 the House of Representatives designated by the Speaker of the 16 House and to the committees of the Senate designated by the 17 President of the Senate, an annual report outlining its 18 planned revenues and expenditures. The Authority shall 19 prepare an annual capital plan which identifies capital 20 projects by location and details the project costs in correct 21 dollar amounts and shall file the annual capital plan with 22 the Governor, the Clerk of the House of Representatives, the 23 Secretary of the Senate, and the Illinois Economic and Fiscal 24 Commission on or prior to March 15th of each year. The 25 Authority shall also prepare and file with the Governor, the 26 Clerk of the House of Representatives, the Secretary of the 27 Senate, and the Illinois Economic and Fiscal Commission a 28 ten-year capital plan that includes a listing of all capital 29 improvement projects contemplated during the ensuing ten-year 30 period. The first ten-year capital plan shall be filed in 31 1991. A revised 10-year capital plan shall be filed in 2001 -2- LRB9110642DHmb 1 and revised every 5 years thereafterand thereafter on the2anniversary of each ten-year period. 3 (c) It shall also be the duty of the Auditor General of 4 the State of Illinois, annually to audit or cause to be 5 audited the books and records of the Authority and to file a 6 certified copy of the report of such audit with the Governor 7 and with the Legislative Audit Commission, which audit 8 reports, when so filed, shall be open to the public for 9 inspection. 10 (Source: P.A. 91-256, eff. 1-1-00.) 11 Section 99.
