91_HB4197 LRB9111809SMmb 1 AN ACT concerning mass transit. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Civil Administrative Code of Illinois is 5 amended by adding Section 2705-320 as follows: 6 (20 ILCS 2705/2705-320 new) 7 Sec. 2705-320. Build Illinois Transit Program; new 8 facilities and service. 9 (a) The Department of Transportation must establish the 10 Build Illinois Transit Program for the construction of and 11 acquisition of property and equipment for new mass 12 transportation facilities and new or expanded mass 13 transportation service, including rapid transit, rail, bus, 14 and other equipment used in connection with mass transit by 15 the State, a public or private entity, or 2 or more of these 16 entities authorized to provide and promote public 17 transportation within the State. 18 (b) For the purpose of this Section: 19 "Carrier" means any public or private entity 20 authorized to provide mass transportation within the State. 21 "Facilities" comprise all real and personal property 22 used in or appurtenant to a mass transportation system. 23 "Mass Transportation" means transportation provided 24 within the State by rapid transit, rail, bus, or other 25 conveyance available to the public on a regular and 26 continuing basis. 27 "Unit of local government" has the meaning provided in 28 Section 1 of Article VII of the Illinois Constitution. 29 (c) Under the Build Illinois Transit Program, the 30 Department may (i) enter into contracts for new mass 31 transportation facilities and (ii) make grants, funded by the -2- LRB9111809SMmb 1 bonds authorized in paragraph (4) of subsection (b) of 2 Section 4 of the General Obligation Bond Act. For the 3 payment of the principal and interest on the bonds, the 4 Comptroller must order transferred and the Treasurer must 5 transfer $293,000,000 annually from the General Revenue Fund 6 to the Build Illinois Transit Program Fund, a special fund 7 created in the State Treasury, until the bonds are retired. 8 (d) The Department must make Build Illinois Transit 9 grants to units of local governments and carriers for the 10 construction of and acquisition of property and equipment for 11 new mass transportation facilities and to provide new or 12 expanded mass transportation service. The grants must be 13 made upon terms and conditions that in the judgment of the 14 Secretary are necessary to ensure their proper and effective 15 use. The Department must make grants for new mass 16 transportation facilities and systems and to provide new or 17 expanded mass transportation service within the State to: 18 (1) Maximize federal funds for the assistance of 19 new mass transportation facilities in Illinois. 20 (2) Facilitate the movement of all persons, 21 including those persons who because of age, economic 22 circumstance, or physical infirmity are unable to drive. 23 (3) Contribute to an improved environment through 24 the reduction of air, water, and noise pollution. 25 (4) Reduce traffic congestion and suburban highway 26 and road sprawl. 27 (5) Facilitate the transportation of Illinois 28 residents to places of employment and to commercial, 29 medical, and shopping districts. 30 (6) Increase the frequency and reliability of 31 public transit service. 32 The Secretary must establish procedures for making 33 application for the Build Illinois Transit grants. The 34 procedures must provide for public notice of all applications -3- LRB9111809SMmb 1 and give reasonable opportunity for the submission of 2 comments and objections by interested parties. The 3 procedures must be designed with a view to facilitating 4 simultaneous application for a grant to the Department and 5 to the federal government. The grants or matching grants may 6 not be made in a total amount that exceeds 100% of the net 7 project cost. Amounts in excess of the project cost must be 8 promptly returned to the Department. 9 Section 10. The State Finance Act is amended by adding 10 Section 5.541 as follows: 11 (30 ILCS 105/5.541 new) 12 Sec. 5.490. The Build Illinois Transit Program Fund. 13 Section 15. The General Obligation Bond Act is amended 14 by changing Sections 2 and 4 as follows: 15 (30 ILCS 330/2) (from Ch. 127, par. 652) 16 Sec. 2. Authorization for Bonds. The State of Illinois 17 is authorized to issue, sell and provide for the retirement 18 of General Obligation Bonds of the State of Illinois in the 19 total amount of $20,077,847,592$16,177,847,592herein called 20 "Bonds". 21 Of the total amount of bonds authorized above, up to 22 $2,200,000,000 in aggregate original principal amount may be 23 issued and sold in accordance with the Baccalaureate Savings 24 Act in the form of General Obligation College Savings Bonds. 25 Of the total amount of bonds authorized above, up to 26 $300,000,000 in aggregate original principal amount may be 27 issued and sold in accordance with the Retirement Savings Act 28 in the form of General Obligation Retirement Savings Bonds. 29 The issuance and sale of Bonds pursuant to the General 30 Obligation Bond Act is an economical and efficient method of -4- LRB9111809SMmb 1 financing the capital needs of the State. This Act will 2 permit the issuance of a multi-purpose General Obligation 3 Bond with uniform terms and features. This will not only 4 lower the cost of registration but also reduce the overall 5 cost of issuing debt by improving the marketability of 6 Illinois General Obligation Bonds. 7 Bonds shall be issued for the categories and specific 8 purposes expressed in Sections 2 through 8 and Section 16 of 9 this Act. 10 (Source: P.A. 90-1, eff. 2-20-97; 90-8, eff. 12-8-97; 90-549, 11 eff. 12-8-97; 90-586, eff. 6-4-98; 91-39, eff. 6-15-99; 12 91-53, eff 6-30-99.) 13 (30 ILCS 330/4) (from Ch. 127, par. 654) 14 Sec. 4. Transportation. The amount of $9,212,270,000 15$5,312,270,000is authorized for use by the Department of 16 Transportation for the specific purpose of promoting and 17 assuring rapid, efficient, and safe highway, air and mass 18 transportation for the inhabitants of the State by providing 19 monies, including the making of grants and loans, for the 20 acquisition, construction, reconstruction, extension and 21 improvement of the following transportation facilities and 22 equipment, and for the acquisition of real property and 23 interests in real property required or expected to be 24 required in connection therewith as follows: 25 (a) $3,431,000,000 for State highways, arterial 26 highways, freeways, roads, bridges, structures separating 27 highways and railroads and roads, and bridges on roads 28 maintained by counties, municipalities, townships or road 29 districts for the following specific purposes: 30 (1) $3,330,000,000 for use statewide, 31 (2) $3,641,000 for use outside the Chicago 32 urbanized area, 33 (3) $7,543,000 for use within the Chicago urbanized -5- LRB9111809SMmb 1 area, 2 (4) $13,060,600 for use within the City of Chicago, 3 (5) $57,894,500 for use within the counties of 4 Cook, DuPage, Kane, Lake, McHenry and Will, and 5 (6) $18,860,900 for use outside the counties of 6 Cook, DuPage, Kane, Lake, McHenry and Will. 7 (b) $5,429,670,000$1,529,670,000for rail facilities 8 and for mass transit facilities, as defined in Section 9 2705-305 of the Department of Transportation Law (20 ILCS 10 2705/2705-305), including rapid transit, rail, bus and other 11 equipment used in connection therewith by the State or any 12 unit of local government, special transportation district, 13 municipal corporation or other corporation or public 14 authority authorized to provide and promote public 15 transportation within the State or two or more of the 16 foregoing jointly, for the following specific purposes: 17 (1) $1,433,870,000 statewide, 18 (2) $83,350,000 for use within the counties of 19 Cook, DuPage, Kane, Lake, McHenry and Will, 20 (3) $12,450,000 for use outside the counties of 21 Cook, DuPage, Kane, Lake, McHenry and Will,.22 (4) $3,900,000,000 for the Build Illinois Transit 23 Program. 24 (c) $351,600,000 for airport or aviation facilities and 25 any equipment used in connection therewith, including 26 engineering and land acquisition costs, by the State or any 27 unit of local government, special transportation district, 28 municipal corporation or other corporation or public 29 authority authorized to provide public transportation within 30 the State, or two or more of the foregoing acting jointly. 31 (Source: P.A. 90-8, eff. 12-8-97 (changed from 6-1-98 by P.A. 32 90-549); 90-586, eff. 6-4-98; 91-39, eff. 6-15-99; 91-239, 33 eff. 1-1-00; revised 8-6-99.)
