91_HB4039 LRB9111363RCtm 1 AN ACT to amend the Code of Criminal Procedure of 1963 by 2 adding Article 106F. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Code of Criminal Procedure of 1963 is 6 amended by adding Article 106F as follows: 7 (725 ILCS 5/Art. 106F heading new) 8 ARTICLE 106F. VIDEOTAPE OF INTERROGATIONS 9 (725 ILCS 5/106F-5 new) 10 Sec. 106F-5. Videotape of interrogations of suspects. 11 (a) A peace officer who interrogates a person suspected 12 of committing an offense must videotape the interrogation and 13 must inform the suspect that the interrogation is being 14 videotaped. 15 (b) The videotape is admissible in court in a 16 prosecution of the suspect for an offense if the suspect 17 confesses to the offense or otherwise makes an admission that 18 may be used in a prosecution of the suspect for the offense 19 and if the suspect recants his or her confession or 20 contradicts any admission made to a peace officer. 21 (c) The failure of a peace officer to videotape the 22 interrogation of a person suspected of an offense renders any 23 confession or other admission made by the suspect 24 inadmissible in any trial of the suspect for the offense for 25 which the suspect has confessed or made an admission. 26 (d) The Department of State Police shall make grants 27 available to local law enforcement agencies, from 28 appropriations made to it, for the purpose of purchasing 29 videotape equipment. -2- LRB9111363RCtm 1 Section 99.
