 1        AN  ACT  to  amend  the  Civil  Administrative  Code   of
 2    Illinois.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The  Department  of  Commerce  and  Community
 6    Affairs  Law  of the Civil Administrative Code of Illinois is
 7    amended by changing Section 605-75 as follows:

 8        (20 ILCS 605/605-75)
 9        Sec. 605-75. Keep Illinois Beautiful.
10        (a)  There is created the Keep Illinois Beautiful Program
11    Advisory Board consisting  of  7  members  appointed  by  the
12    Governor with the advice and consent of the Senate.  Of those
13    7,  4  shall  be  appointed  from a list of at least 10 names
14    submitted  by  the  boards  of  directors  from  the  various
15    certified  community  programs.   Each  certified   community
16    program  may  submit only one recommendation to be considered
17    by the Governor.  The  Director  of  Commerce  and  Community
18    Affairs Lieutenant Governor or his or her designee shall be a
19    member  and serve as Chairman, except that (i) when Section 6
20    of Article V of the Illinois Constitution  is  operative  the
21    officer  next  in  line of succession shall serve as Chairman
22    and  (ii)  until  January  11,  1999,  while  the  office  of
23    Lieutenant Governor  is  otherwise  vacant,  the  powers  and
24    duties of the Lieutenant Governor under this Section shall be
25    carried  out  as  provided  in  Section  67.35  of  the Civil
26    Administrative Code  of  Illinois  (renumbered;  now  Section
27    405-500 of the Department of Central Management Services Law,
28    20   ILCS  405/405-500).   The  Board  shall  meet  at  least
29    quarterly at the discretion of the Chairman and at such other
30    times as the Chairman or any 4  members  consider  necessary.
31    Four members shall constitute a quorum.

 1        (b)  The  purpose  of  the Board shall be to assist local
 2    governments and community organizations in:
 3             (1)  Educating  the  public  about  the   need   for
 4        recycling and reducing solid waste.
 5             (2)  Promoting  the  establishment  of recycling and
 6        programs that reduce litter and other solid waste through
 7        re-use and diversion.
 8             (3)  Developing local markets for recycled products.
 9             (4)  Cooperating with other State agencies and  with
10        local governments having environmental responsibilities.
11             (5)  Seeking    funding    from   governmental   and
12        non-governmental sources.
13        (c)  The Department of  Commerce  and  Community  Affairs
14    Lieutenant  Governor  shall  employ  and  fix the salary of a
15    Statewide coordinator who,  to  the  extent  possible,  shall
16    assist  local  governments  and  community organizations that
17    plan to implement programs set forth in subsection (b).   The
18    Board shall establish guidelines for the certification by the
19    Board  of local governments and community organizations.  The
20    guidelines shall be approved by a majority of the members  of
21    the Board.
22        The Statewide coordinator may encourage local governments
23    and  community  organizations  to  apply for certification of
24    programs by the Board.  However,  the  Statewide  coordinator
25    shall  give  equal  consideration to newly certified programs
26    and older certified programs.
27        The Statewide coordinator shall submit proposed  programs
28    to the Board.  The Board shall approve program proposals by a
29    majority  vote  of the quorum present.  In no event shall the
30    Board veto a program by a vote of fewer  than  4  members.  A
31    vetoed  proposal  may  be  resubmitted  to  the  Board by the
32    Statewide coordinator after necessary changes in the proposal
33    have been made.
34        (d)  The Keep Illinois Beautiful Fund  is  created  as  a

 1    special  fund  in the State treasury.  Moneys from any public
 2    or private source may be deposited  into  the  Keep  Illinois
 3    Beautiful  Fund.   Moneys in the Keep Illinois Beautiful Fund
 4    shall be appropriated only for the purposes of this  Section.
 5    Pursuant  to  action by the Board, the Department of Commerce
 6    and  Community  Affairs  Lieutenant  Governor  may  authorize
 7    grants  from  moneys  appropriated  from  the  Keep  Illinois
 8    Beautiful Fund for certified community based programs for  up
 9    to  50%  of  the cash needs of the program; provided, that at
10    least 50% of the needs of the program shall be contributed to
11    the program in cash, and not in kind, by local sources.
12        Moneys  appropriated  for   certified   community   based
13    programs  in municipalities of more than 1,000,000 population
14    shall be itemized separately and may not be disbursed to  any
15    other community.
16        (e)  On  the effective date of this amendatory Act of the
17    91st General Assembly, the Lieutenant Governor shall transfer
18    to the Department of Commerce and Community Affairs, and  the
19    Department  shall  receive, all assets and property possessed
20    by  the  Lieutenant  Governor  under  this  Section  and  all
21    liabilities and obligations for which the Lieutenant Governor
22    was  responsible  under  this  Section.   Nothing   in   this
23    subsection  affects the validity of certifications and grants
24    issued under this Section before the effective date  of  this
25    amendatory Act of the 91st General Assembly.

27        Section  99.  Effective date.  This Act takes effect July
28    1, 2000.
