91_HB3993eng HB3993 Engrossed LRB9112503NTsb 1 AN ACT to amend the Public Community College Act by 2 changing Sections 2-16.03 and 3-37. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Public Community College Act is amended 6 by changing Sections 2-16.03 and 3-37 as follows: 7 (110 ILCS 805/2-16.03) (from Ch. 122, par. 102-16.2) 8 Sec. 2-16.03. The AFDC Opportunities Fund is hereby 9 created in the State Treasury. Each month there shall be 10 transferred into that Fund as provided in subsection (d) of 11 Section 12-10.3 of the Illinois Public Aid Code all amounts 12 credited for deposit in the special account established and 13 maintained in the Employment and Training Fund as provided in 14 Section 12-5 of the Illinois Public Aid Code. 15 Expenditures and distributions from the AFDC 16 Opportunities Fund shall be made by the State Board, pursuant 17 to appropriations made by the General Assembly from that 18 Fund, for grants to public community colleges for costs of 19 work force training and technologyservices rendered under20the federal programsand for the operating expenses made and 21 incurred by the State Board in connection with these purposes 22the exercise of its responsibilities with the JOBS program in23this State. 24 (Source: P.A. 87-860; 88-45.) 25 (110 ILCS 805/3-37) (from Ch. 122, par. 103-37) 26 Sec. 3-37. To build, buy or lease suitable buildings 27 upon a site approved by the State Board and issue bonds, in 28 the manner provided in Article IIIA, or, with the prior 29 approval ofthe Board of Higher Education andthe Illinois 30 Community College Board, enter into an installment loan HB3993 Engrossed -2- LRB9112503NTsb 1 arrangement with a financial institution with a payback 2 period of less than 20 years provided the board has entered 3 into a contractual agreement which provides sufficient 4 revenue to pay such loan in full from sources other than 5 local taxes, tuition, or State appropriations and to provide 6 adequate additional operation and maintenance funding for the 7 term of the agreement, for the purpose of borrowing money to 8 buy sites and to either or both buy or build and equip 9 buildings and improvements, and for the purpose of10transferring funds to the Illinois Building Authority. 11 Any provision in a contractual agreement providing for an 12 installment loan agreement authorized by this Section that 13 obligates the State of Illinois is against public policy and 14 shall be null and void. 15 (Source: P.A. 83-576.) 16 Section 99. Effective date. This Act takes effect upon 17 becoming law.
