91_HB3933 LRB9112125RCpk 1 AN ACT to amend the Criminal Code of 1961 by adding 2 Section 12-21.7. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Criminal Code of 1961 is amended by 6 adding Section 12-21.7 as follows: 7 (720 ILCS 5/12-21.7 new) 8 Sec. 12-21.7. Seduction of a minor. 9 (a) A person commits the offense of seduction of a minor 10 when that person: 11 (1) knows that another person is under 18 years of 12 age or fails to exercise reasonable care in ascertaining 13 the true age of the other person: 14 (2) knowingly distributes, sends, causes to be sent, 15 exhibits, or offers to distribute, send, cause to be 16 sent, or exhibit any harmful material, as defined in 17 Section 11-21 of this Code, to the other person under 18 18 years of age by live or recorded telephone message, 19 electronic mail, the Internet, a commercial online 20 service, or other means; and 21 (3) intends to arouse, appeal to, or gratify the 22 lust, passions, or sexual desire of himself or herself or 23 of that other person under 18 years of age for the 24 purpose of seducing that other person. 25 (b) It is a defense to any prosecution under this 26 Section that a parent or guardian committed the act charged 27 in aid of legitimate sex education. 28 (c) It is a defense to any prosecution under this 29 Section that the act charged was committed in aid of 30 legitimate scientific or educational purposes. 31 (d) It is not a violation of this Section for a -2- LRB9112125RCpk 1 telephone company, a cable television service as defined in 2 Section 16-10 of this Code or any of its affiliates, an 3 Internet service provider, or a commercial online service 4 provider to carry, broadcast, or transmit messages described 5 in this Section or perform related activities in providing 6 telephone, cable television, Internet, or commercial online 7 services. 8 (e) Sentence. Seduction of a minor is a Class A 9 misdemeanor. A second or subsequent violation of this 10 Section is a Class 4 felony. 11 Section 99. Effective date. This Act takes effect upon 12 becoming law.
