91_HB3901eng HB3901 Engrossed LRB9112326DHmb 1 AN ACT concerning Illinois Correctional Employee Memorial 2 license plates. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The State Finance Act is amended by adding 6 Section 5.541 as follows: 7 (30 ILCS 105/5.541 new) 8 Sec. 5.541. The Illinois Correctional Employee Memorial 9 Fund. 10 Section 10. The Illinois Vehicle Code is amended by 11 adding Section 3-645 as follows: 12 (625 ILCS 5/3-645 new) 13 Sec. 3-645. Illinois Correctional Employee Memorial 14 license plates. 15 (a) The Secretary, upon receipt of an application made 16 in the form prescribed by the Secretary, may issue special 17 registration plates designated as Illinois Correctional 18 Employee Memorial license plates. The special plates issued 19 under this Section shall be affixed only to passenger 20 vehicles of the first division and motor vehicles of the 21 second division weighing not more than 8,000 pounds. Plates 22 issued under this Section shall expire according to the 23 multi-year procedure established by Section 3-414.1 of this 24 Code. 25 (b) The design and color of the plates is wholly within 26 the discretion of the Secretary. The Secretary may allow the 27 plates to be issued as vanity plates or personalized under 28 Section 3-405.1 of this Code. The Secretary shall prescribe 29 stickers or decals as provided under Section 3-412 of this HB3901 Engrossed -2- LRB9112326DHmb 1 Code. 2 (c) An applicant for the special plate shall be charged 3 a $25 fee for original issuance in addition to the 4 appropriate registration fee. Of this fee, $10 shall be 5 deposited into the Illinois Correctional Employee Memorial 6 Fund and $15 shall be deposited into the Secretary of State 7 Special License Plate Fund, to be used by the Secretary to 8 help defray the administrative processing costs. 9 For each registration renewal period, a $17 fee, in 10 addition to the appropriate registration fee, shall be 11 charged. Of this fee, $15 shall be deposited into the 12 Illinois Correctional Employee Memorial Fund and $2 shall be 13 deposited into the Secretary of State Special License Plate 14 Fund. 15 (d) The Illinois Correctional Employee Memorial Fund is 16 created as a special fund in the State treasury. All money 17 in the Illinois Correctional Employee Memorial Fund shall, 18 subject to appropriation by the General Assembly and approval 19 by the Secretary, be used by the Department of Corrections 20 for construction of the Illinois Correctional Employee 21 Memorial, to be located at the State Capitol grounds in 22 Springfield, Illinois. Upon the completion of the Memorial, 23 the Office of the State Fire Marshal shall certify to the 24 State Treasurer that construction of the Memorial has been 25 completed. Upon the certification by the State Fire Marshal, 26 the State Treasurer shall transfer all moneys in the Fund and 27 any future deposits into the Secretary of State Special 28 License Plate Fund.
