91_HB3617enr HB3617 Enrolled LRB9112379MWpc 1 AN ACT concerning local boards. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Counties Code is amended by changing 5 Sections 2-3002.5 and 2-3006 as follows: 6 (55 ILCS 5/2-3002.5) 7 Sec. 2-3002.5. Beginning with members elected at the 8 general election in 2002January 2, 2001, counties having a 9 population between 800,000 and 3,000,000 according to 2000 10 decennial census shall have no more than 18 members on their 11 county board. If the chairman of the county board is elected 12 at-large by the voters of the county as provided in Section 13 2-3007, the chairman shall not be counted as a member of the 14 county board for the purpose of the limitations on the size 15 of the county board provided in this Section. Neither a 16 member nor the chairman of that county board shall serve 17 simultaneously as commissioner or president of the board of 18 commissioners of the forest preserve district. No person 19 shall seek election to both the county board and the forest 20 preserve commission at the same election. 21 (Source: P.A. 89-577, eff. 1-1-97.) 22 (55 ILCS 5/2-3006) (from Ch. 34, par. 2-3006) 23 Sec. 2-3006. Failure to file apportionment plan; election 24 of board members at large. If no apportionment plan is filed 25 with the county clerk as required by this Division, the 26 members of the county board shall be elected at large in the 27 county. If the county board has determined the number of 28 members for the board, that number shall be elected; 29 otherwise, the number of members to be elected shall be the 30 largest number to which the county is entitled under Sections 31 2-3002 and 2-3002.5. The Downstate Forest Preserve District Act 3 is amended by changing Sections 3c and 12 as follows: 4 (70 ILCS 805/3c) 5 Sec. 3c. Elected board of commissioners in certain 6 counties. If the boundaries of a district are co-extensive 7 with the boundaries of a county having a population of more 8 than 800,000 but less than 3,000,000, all commissioners of 9 the forest preserve district shall be elected from the same 10 districts as members of the county board beginning with the 11 general election held in 2002 and each succeeding general 12 election. One commissioner shall be elected from each 13 district. At their first meeting after their election in 14 2002 and following each subsequent decennial reapportionment 15 of the county under Division 2-3 of the Counties Code, the 16 elected commissioners shall publicly by lot divide themselves 17 into32 groups, as equal in size as possible. Commissioners 18 from the first group shall serve for terms of 2, 4, and 4 19 years;commissioners from the second group shall serve for20terms of 4, 2, and 4 yearsand commissioners from the second 21thirdgroup shall serve terms of 4, 4, and 2 years. 22 Commissioners elected under this Section shall take office at 23 the first meeting of commissioners following an election of 24 commissioners. Beginning with the general election in 2002, 25 the president of the board of commissioners of the forest 26 preserve district shall be elected by the voters of the 27 county, rather than by the commissioners. The president 28 shall be elected throughout the county for a 4-year term 29 without having been first elected as commissioner of the 30 forest preserve district. Neither a commissioner nor the 31 president of the board of commissioners of that forest 32 preserve district shall serve simultaneously as member or HB3617 Enrolled -3- LRB9112379MWpc 1 chairman of the county board. No person shall seek election 2 to both the forest preserve commission and the county board 3 at the same election.At that meeting, the commissioners4shall elect from among their number a president of the forest5preserve district board of commissioners to serve for a term6of 2 years. The board of commissioners shall setThe 7 compensation for the president shall be an amount equal to 8 85% of the annual salary of the county board chairman. The 9 president, with the advice and consent of the board of 10 commissioners shall appoint a secretary, treasurer, and such 11 other officers as deemed necessary by the board of 12 commissioners, which officers need not be members of the 13 board of commissioners. The president shall have the powers 14 and duties as specified in Section 12 of this Act.Actions by15the board shall require a majority vote of the commissioners.16 Candidates for commissioner shall be candidates of 17 established political parties. 18 If a vacancy in the office of commissioner occurs, other 19 than by expiration of a commissioner's term, the president of 20 the board of commissioners shall, with the advice and consent 21 of other commissioners then serving, appoint an individual to 22 serve for the remainder of the unexpired term. The appointee 23 shall be affiliated with the same political party as the 24 commissioner in whose office the vacancy occurred and be a 25 resident of such district. If a vacancy in the office of 26 president occurs, other than by expiration of the president's 27 term, the remaining members of the board of commissioners 28 shall appoint one of the commissioners to serve as president 29 for the remainder of the unexpired term. If, however, more 30 than 28 months remain in the unexpired term of a commissioner 31 or the president, the appointment shall be until the next 32 consolidated election, at which time the vacated office of 33 commissioner or president shall be filled by election for the 34 remainder of the term. HB3617 Enrolled -4- LRB9112379MWpc 1 The president and commissioners elected under this 2 Section may be reimbursed for their reasonable expenses 3 actually incurred in performing their official duties under 4 this Act in accordance with the provisions of Section 3a. 5 The reimbursement paid under this Section shall be paid by 6 the forest preserve district. 7 Compensation for forest preserve commissioners elected 8 under this Section shall be the same as that of county board 9 members of the county with which the forest preserve 10 district's boundaries are co-extensive. 11 (Source: P.A. 89-577, eff. 1-1-97.) 12 (70 ILCS 805/12) (from Ch. 96 1/2, par. 6322) 13 Sec. 12. The president of the board of any district 14 organized hereunder, shall preside at all meetings of the 15 board,andbe the executive officer of the district, and be a 16 member of the board. He shall sign all ordinances, 17 resolutions and other papers necessary to be signed and shall 18 execute all contracts entered into by the district and 19 perform other duties as may be prescribed by ordinance. He 20 may veto any ordinance and any orders, resolutions and 21 actions, or any items therein contained, of the board which 22 provide for the purchase of real estate, or for the 23 construction of improvements within the preserves of the 24 district. Such veto shall be filed with the secretary of the 25 board within 5 days after the passage of the ordinance, 26 order, resolution or action and when so vetoed the ordinance, 27 order, resolution or action or any item therein contained is 28 not effective unless it is again passed by two-thirds vote of 29 all the members of the board. The president may vote in the 30 same manner as the other members of the board. In the 31 temporary absence or inability of the president, the members 32 of the board may elect from their own number a president, pro 33 tem. HB3617 Enrolled -5- LRB9112379MWpc 1 The "Yeas" and "Nays" shall be taken, and entered on the 2 journal of the board's proceedings, upon the passage of all 3 ordinances and all proposals to create any liability, or for 4 the expenditure or appropriation of money. The concurrence of 5 a majority of all the members elected or appointed to the 6 board is necessary to the passage of any such ordinance or 7 proposal. In all other cases the "Yeas" and "Nays" shall be 8 taken at the request of any member of the board and shall be 9 entered on the journal of the board's proceedings. 10 (Source: P.A. 85-933.) 11 Section 99.
