91_HB3557eng HB3557 Engrossed LRB9112783JMmb 1 AN ACT in relation to legislative information, amending 2 named Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The General Assembly Organization Act is 6 amended by adding Section 15 as follows: 7 (25 ILCS 5/15 new) 8 Sec. 15. Interference with legislative information. 9 (a) Any person who, without lawful authorization, 10 knowingly falsifies, destroys, tampers with, removes, or 11 conceals any data or record maintained by the General 12 Assembly or any of its agencies on computer equipment of the 13 General Assembly or any of its agencies commits a Class 4 14 felony. 15 (b) Any person who knowingly and with malicious intent 16 falsifies any copy or representation of any data or record 17 made available by the General Assembly or any of its agencies 18 commits a Class 4 felony. 19 Section 10. The Legislative Information System Act is 20 amended by changing Section 5.09 as follows: 21 (25 ILCS 145/5.09) 22 Sec. 5.09. Public computer access; legislative 23 information. To make available to the public all of the 24 following information in electronic form: 25 (1) On or before July 1, 1999, the weekly schedule 26 of legislative floor sessions for each of the 2 houses of 27 the General Assembly together with a list of matters 28 pending before them and the weekly schedule of 29 legislative committee hearings together with matters HB3557 Engrossed -2- LRB9112783JMmb 1 scheduled for their consideration. 2 (2) On or before July 1, 1999, a list of the 3 committees of the General Assembly and their members. 4 (3) On or before July 1, 1999, the text of each 5 bill and resolution introduced and of each engrossed, 6 enrolled, and re-enrolled bill and resolution and the 7 text of each adopted amendment and conference committee 8 report. 9 (4) On or before July 1, 1999, a synopsis of items 10 specified in paragraph (3) of this Section, together with 11 a summary of legislative and gubernatorial actions 12 regarding each bill and resolution introduced. 13 (5) On or before July 1, 1999, the Rules of the 14 House and the Senate of the General Assembly. 15 (6) Before the conclusion of the Ninety-second 16 General Assembly, the text of Public Acts. 17 (7) Before the conclusion of the Ninety-second 18 General Assembly, the Illinois Compiled Statutes. 19 (8) Before the conclusion of the Ninety-second 20 General Assembly, the Constitution of the United States 21 and the Constitution of the State of Illinois. 22 (9) Before the conclusion of the Ninety-second 23 General Assembly, the text of the Illinois Administrative 24 Code. 25 (10) Before the conclusion of the Ninety-second 26 General Assembly, the most current issue of the Illinois 27 Register published on or after the effective date of this 28 amendatory Act of 1998. 29 (10.1) Each roll call vote taken by each full 30 chamber of the General Assembly showing, in searchable 31 form, the individual vote of each individual member. 32 Each roll call vote shall be made available pursuant to 33 this item (10.1) not later than 2 business days after the 34 conclusion of the legislative day in which it is HB3557 Engrossed -3- LRB9112783JMmb 1 recorded. A reasonably clear description of the matter 2 being voted upon shall be available for each roll call 3 vote. For purposes of this item (10.1), "roll call vote" 4 means any action by either full chamber of the General 5 Assembly in which the yeas and nays are recorded. This 6 item (10.1) applies to all roll call votes taken in the 7 92nd General Assembly and thereafter. 8 (10.2) All transcripts of debate required to be 9 kept by subsection (b) of Section 7 of Article IV of the 10 Illinois Constitution in searchable text form as follows: 11 (A) The transcript of debate for each 12 legislative day of any session of the 91st General 13 Assembly held pursuant to subsection (a) of Section 14 5 of Article IV of the Illinois Constitution or to 15 consider actions of the Governor pursuant to Section 16 9 of Article IV of the Illinois Constitution shall 17 be made available as the transcript is prepared and 18 corrected. 19 (B) The transcript of debate for each 20 legislative day of any session of the General 21 Assembly held after the effective date of this 22 amendatory Act of the 91st General Assembly and 23 pursuant to subsection (b) of Section 5 of Article 24 IV of the Illinois Constitution shall be made 25 available as the transcript is prepared and 26 corrected. 27 (C) The transcript of debate for each 28 legislative day of any session of the 92nd or any 29 subsequent General Assembly held pursuant to 30 subsection (a) of Section 5 of Article IV of the 31 Illinois Constitution or to consider actions of the 32 Governor pursuant to Section 9 of Article IV of the 33 Illinois Constitution shall be made available as the 34 transcript is prepared and corrected, but in no HB3557 Engrossed -4- LRB9112783JMmb 1 event later than the tenth business day after the 2 beginning of the next following session of the 3 General Assembly held pursuant to subsection (a) of 4 Section 5 of Article IV of the Illinois 5 Constitution. 6 (10.3) All audio streams controlled by the Clerk of 7 the House and the Secretary of the Senate and made 8 available by these officers to the Capitol complex shall 9 be made available uninterrupted and digitally recordable 10 on the World Wide Web. This item (10.3) applies for all 11 audio streams beginning with the first legislative day of 12 the 92nd General Assembly and thereafter. 13 (11) Any other information that the Joint Committee 14 on Legislative Support Services elects to make available. 15 Notwithstanding the provisions of this Section, the 16 failure to meet any of the time deadlines set forth in this 17 Section shall not constitute a violation of this Section when 18 the delay is due to a legitimate technical failure. However, 19 in those instances, the required information shall be made 20 available as soon as is reasonably practicable. 21 The information shall be made available to the public 22 through the World Wide Web. The information may also be made 23 available by any other means of access that would facilitate 24 public access to the information. 25 Any documentation that describes the electronic digital 26 formats of the information shall be made available through 27 the World Wide Web. 28 Personal information concerning a person who accesses 29 this public information may be maintained only for the 30 purpose of providing service to the person. 31 No fee or other charge may be imposed by the Legislative 32 Information System as a condition of accessing the 33 information, except that a reasonable fee may be charged for 34 any customized services and shall be deposited into the HB3557 Engrossed -5- LRB9112783JMmb 1 General Assembly Computer Equipment Revolving Fund. 2 The electronic public access provided through the World 3 Wide Web shall be in addition to any other electronic or 4 print distribution of the information. 5 No action taken under this Section shall be deemed to 6 alter or relinquish any copyright or other proprietary 7 interest or entitlement of the State of Illinois relating to 8 any of the information made available under this Section. 9 The information shall be made available as provided in 10 this Section in the shortest practicable time after it is 11 publicly available in any other form; provided that the 12 System may make information available under this Section only 13 if the availability in no way reduces the quality and 14 timeliness of service available to and required under this 15 Act for legislative users and does not unduly burden the 16 General Assembly or its support services agencies. Failure 17 to provide information under this Section does not affect the 18 validity of any action of the General Assembly. The General 19 Assembly and the State of Illinois are not liable for the 20 accuracy, availability, or use of the information provided 21 under this Section. 22 (Source: P.A. 90-666, eff. 7-30-98.) 23 Section 99. Effective date. This Act takes effect upon 24 becoming law.
