91_HB3535 LRB9112277MWpcA 1 AN ACT to create the Municipal Assistance Commission. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Department of Commerce and Community 5 Affairs Law of the Civil Administrative Code of Illinois is 6 amended by adding Section 605-455 as follows: 7 (20 ILCS 605/605-455 new) 8 Sec. 605-455. Municipal Assistance Commission. 9 (a) There is created in the Department a Municipal 10 Assistance Commission consisting of 10 members, including the 11 Director, or his or her designee, and 9 members of the public 12 appointed by the Governor. Two of the public members must be 13 residents Cook County outside of the City of Chicago, 3 14 public members must be residents of a county adjacent to Cook 15 County, and 4 public members must be residents of other areas 16 of the State. Public members of the Commission may not be 17 officers or employees of a unit of local government. 18 The initial appointments shall be made as soon as 19 possible after the effective date of this amendatory Act of 20 the 91st General Assembly. Of the initial appointments, 5 21 members shall serve for 2 years and 4 members shall serve for 22 4 years. Thereafter, all members shall serve for terms of 4 23 years and until their successors are appointed and qualified. 24 Vacancies in the membership of the Commission shall be filled 25 in the same manner as the original appointments. 26 Members of the Commission shall serve without 27 compensation, but may be reimbursed for necessary expenses 28 incurred in the performance of their duties. 29 (b) The Commission shall make grants to units of local 30 government, other than the City of Chicago, from the 31 Municipal Assistance Grant Fund. A unit of local government -2- LRB9112277MWpcA 1 that (i) is located in an area in need of economic 2 development, (ii) has developed a specific proposal for 3 economic development, and (iii) does not have available local 4 revenues necessary to implement the proposal may apply to the 5 Commission for a grant. The Commission may make a grant to 6 the unit of local government if the Commission believes the 7 proposal has a reasonable possibility of success and at least 8 6 members of the Commission approve the proposal. 9 In determining whether or not to make a grant to a unit 10 of local government, the Commission shall consider the per 11 capita income of the community, the unemployment rate in the 12 community, the relative probability of the success of the 13 unit of local government's proposal compared to other 14 proposals, the availability of adequate transportation 15 infrastructure, and the availability of trained individuals 16 and adequate financing to carry out the proposal. 17 Units of local government that receive grants from the 18 Commission must file periodic progress reports. The 19 Commission shall monitor and conduct on-site inspections of 20 all projects conducted with grant moneys. 21 (c) The Commission must adopt any rules necessary to 22 implement and administer this Section. 23 (d) There is created the Municipal Assistance Grant Fund, 24 a special fund in the State treasury. Moneys appropriated 25 for the purposes of this Section and moneys from any other 26 public or private source shall be deposited into the Fund. 27 Moneys in the Fund may be used by the Commission, subject to 28 appropriation, to make grants to units of local government 29 under this Section. 30 Section 10. This Act takes effect on 3 January 1, 2001.
