91_HB3481 LRB9112316SMdvA 1 AN ACT concerning volunteer firefighters, amending named 2 Acts. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 3. The Illinois Income Tax Act is amended by 6 adding Section 212 as follows: 7 (35 ILCS 5/212 new) 8 Sec. 212. Volunteer firefighter tax credit. For taxable 9 years 2000 through 2004, each taxpayer who was a volunteer or 10 paid-on-call firefighter during the entire taxable year is 11 entitled to a credit against the tax imposed by subsections 12 (a) and (b) of Section 201 in the amount of $1,000. If the 13 amount of the credit exceeds the tax liability for the year, 14 the excess may be carried forward and applied to the tax 15 liability of the 2 taxable years following the excess credit 16 year. The credit shall be applied to the earliest year for 17 which there is a tax liability. If there are credits from 18 more than one tax year that are available to offset a 19 liability, the earlier credit shall be applied first. 20 Section 5. The University of Illinois Act is amended by 21 adding Section 7h as follows: 22 (110 ILCS 305/7h new) 23 Sec. 7h. Volunteer firefighter tuition waiver. 24 (a) Each year, subject to State appropriation to 25 reimburse the University for the loss of tuition under this 26 Section, the Board of Trustees shall offer a full tuition 27 waiver for undergraduate education at any campus under its 28 governance to (i) any person who has served as a volunteer 29 firefighter for the entire year previous to the commencement -2- LRB9112316SMdvA 1 of the academic year during which the tuition waiver is to be 2 effective or (ii) any member of that person's immediate 3 family. To be eligible to receive a tuition waiver under 4 this Section, (i) no other member of the applicant's 5 immediate family may receive a tuition waiver under this 6 Section, Section 8h of the Southern Illinois University 7 Management Act, Section 5-92 of the Chicago State University 8 Law, Section 10-92 of the Eastern Illinois University Law, 9 Section 15-92 of the Governors State University Law, Section 10 20-92 of the Illinois State University Law, Section 25-92 of 11 the Northeastern Illinois University Law, Section 30-92 of 12 the Northern Illinois University Law, or Section 35-92 of the 13 Western Illinois University Law for the same academic year 14 that the applicant's tuition waiver is for, unless the other 15 member served as a volunteer firefighter for the entire year 16 previous to the commencement of that academic year or is a 17 member of the immediate family of a person, other than the 18 applicant, who has served as a volunteer firefighter for the 19 entire year previous to the commencement of that academic 20 year, and (ii) the applicant must qualify for admission to 21 the University under the same admissions requirements, 22 standards, and policies that the University applies to 23 applicants for admission generally to its respective 24 undergraduate colleges and programs. 25 (b) Subject to the provisions and limitations of 26 subsection (a) of this Section, an eligible applicant who has 27 continued to maintain satisfactory academic progress toward 28 graduation may have his or her tuition waiver renewed until 29 such time as he or she has expended 4 years of undergraduate 30 tuition waiver benefits under this Section. 31 (c) No tuition waiver offered or allocated to an 32 eligible applicant in accordance with the provisions of this 33 Section shall be charged against any tuition waiver 34 limitation established by the Board of Higher Education. -3- LRB9112316SMdvA 1 (d) The Board of Trustees shall prescribe such rules as 2 are necessary to implement and administer the provisions of 3 this Section. 4 Section 10. The Southern Illinois University Management 5 Act is amended by adding Section 8h as follows: 6 (110 ILCS 520/8h new) 7 Sec. 8h. Volunteer firefighter tuition waiver. 8 (a) Each year, subject to State appropriation to 9 reimburse the University for the loss of tuition under this 10 Section, the Board shall offer a full tuition waiver for 11 undergraduate education at any campus under its governance to 12 (i) any person who has served as a volunteer firefighter for 13 the entire year previous to the commencement of the academic 14 year during which the tuition waiver is to be effective or 15 (ii) any member of that person's immediate family. To be 16 eligible to receive a tuition waiver under this Section, (i) 17 no other member of the applicant's immediate family may 18 receive a tuition waiver under this Section, Section 7h of 19 the University of Illinois Act, Section 5-92 of the Chicago 20 State University Law, Section 10-92 of the Eastern Illinois 21 University Law, Section 15-92 of the Governors State 22 University Law, Section 20-92 of the Illinois State 23 University Law, Section 25-92 of the Northeastern Illinois 24 University Law, Section 30-92 of the Northern Illinois 25 University Law, or Section 35-92 of the Western Illinois 26 University Law for the same academic year that the 27 applicant's tuition waiver is for, unless the other member 28 served as a volunteer firefighter for the entire year 29 previous to the commencement of that academic year or is a 30 member of the immediate family of a person, other than the 31 applicant, who has served as a volunteer firefighter for the 32 entire year previous to the commencement of that academic -4- LRB9112316SMdvA 1 year, and (ii) the applicant must qualify for admission to 2 the University under the same admissions requirements, 3 standards, and policies that the University applies to 4 applicants for admission generally to its respective 5 undergraduate colleges and programs. 6 (b) Subject to the provisions and limitations of 7 subsection (a) of this Section, an eligible applicant who has 8 continued to maintain satisfactory academic progress toward 9 graduation may have his or her tuition waiver renewed until 10 such time as he or she has expended 4 years of undergraduate 11 tuition waiver benefits under this Section. 12 (c) No tuition waiver offered or allocated to an 13 eligible applicant in accordance with the provisions of this 14 Section shall be charged against any tuition waiver 15 limitation established by the Board of Higher Education. 16 (d) The Board shall prescribe such rules as are 17 necessary to implement and administer the provisions of this 18 Section. 19 Section 15. The Chicago State University Law is amended 20 by adding Section 5-92 as follows: 21 (110 ILCS 660/5-92 new) 22 Sec. 5-92. Volunteer firefighter tuition waiver. 23 (a) Each year, subject to State appropriation to 24 reimburse the University for the loss of tuition under this 25 Section, the Board shall offer a full tuition waiver for 26 undergraduate education at any campus under its governance to 27 (i) any person who has served as a volunteer firefighter for 28 the entire year previous to the commencement of the academic 29 year during which the tuition waiver is to be effective or 30 (ii) any member of that person's immediate family. The Eastern Illinois University Law is 2 amended by adding Section 10-92 as follows: 3 (110 ILCS 665/10-92 new) 4 Sec. 10-92. Volunteer firefighter tuition waiver. 5 (a) Each year, subject to State appropriation to 6 reimburse the University for the loss of tuition under this 7 Section, the Board shall offer a full tuition waiver for 8 undergraduate education at any campus under its governance to 9 (i) any person who has served as a volunteer firefighter for 10 the entire year previous to the commencement of the academic 11 year during which the tuition waiver is to be effective or 12 (ii) any member of that person's immediate family. To be 13 eligible to receive a tuition waiver under this Section, (i) 14 no other member of the applicant's immediate family may 15 receive a tuition waiver under this Section, Section 7h of 16 the University of Illinois Act, Section 8h of the Southern 17 Illinois University Management Act, Section 5-92 of the 18 Chicago State University Law, Section 15-92 of the Governors 19 State University Law, Section 20-92 of the Illinois State 20 University Law, Section 25-92 of the Northeastern Illinois 21 University Law, Section 30-92 of the Northern Illinois 22 University Law, or Section 35-92 of the Western Illinois 23 University Law for the same academic year that the 24 applicant's tuition waiver is for, unless the other member 25 served as a volunteer firefighter for the entire year 26 previous to the commencement of that academic year or is a 27 member of the immediate family of a person, other than the 28 applicant, who has served as a volunteer firefighter for the 29 entire year previous to the commencement of that academic 30 year, and (ii) the applicant must qualify for admission to 31 the University under the same admissions requirements, 32 standards, and policies that the University applies to 33 applicants for admission generally to its respective -7- LRB9112316SMdvA 1 undergraduate colleges and programs. 2 (b) Subject to the provisions and limitations of 3 subsection (a) of this Section, an eligible applicant who has 4 continued to maintain satisfactory academic progress toward 5 graduation may have his or her tuition waiver renewed until 6 such time as he or she has expended 4 years of undergraduate 7 tuition waiver benefits under this Section. 8 (c) No tuition waiver offered or allocated to an 9 eligible applicant in accordance with the provisions of this 10 Section shall be charged against any tuition waiver 11 limitation established by the Board of Higher Education. 12 (d) The Board shall prescribe such rules as are 13 necessary to implement and administer the provisions of this 14 Section. 15 Section 25. The Governors State University Law is 16 amended by adding Section 15-92 as follows: 17 (110 ILCS 670/15-92 new) 18 Sec. 15-92. Volunteer firefighter tuition waiver. 19 (a) Each year, subject to State appropriation to 20 reimburse the University for the loss of tuition under this 21 Section, the Board shall offer a full tuition waiver for 22 undergraduate education at any campus under its governance to 23 (i) any person who has served as a volunteer firefighter for 24 the entire year previous to the commencement of the academic 25 year during which the tuition waiver is to be effective or 26 (ii) any member of that person's immediate family. To be 27 eligible to receive a tuition waiver under this Section, (i) 28 no other member of the applicant's immediate family may 29 receive a tuition waiver under this Section, Section 7h of 30 the University of Illinois Act, Section 8h of the Southern 31 Illinois University Management Act, Section 5-92 of the 32 Chicago State University Law, Section 10-92 of the Eastern -8- LRB9112316SMdvA 1 Illinois University Law, Section 20-92 of the Illinois State 2 University Law, Section 25-92 of the Northeastern Illinois 3 University Law, Section 30-92 of the Northern Illinois 4 University Law, or Section 35-92 of the Western Illinois 5 University Law for the same academic year that the 6 applicant's tuition waiver is for, unless the other member 7 served as a volunteer firefighter for the entire year 8 previous to the commencement of that academic year or is a 9 member of the immediate family of a person, other than the 10 applicant, who has served as a volunteer firefighter for the 11 entire year previous to the commencement of that academic 12 year, and (ii) the applicant must qualify for admission to 13 the University under the same admissions requirements, 14 standards, and policies that the University applies to 15 applicants for admission generally to its respective 16 undergraduate colleges and programs. 17 (b) Subject to the provisions and limitations of 18 subsection (a) of this Section, an eligible applicant who has 19 continued to maintain satisfactory academic progress toward 20 graduation may have his or her tuition waiver renewed until 21 such time as he or she has expended 4 years of undergraduate 22 tuition waiver benefits under this Section. 23 (c) No tuition waiver offered or allocated to an 24 eligible applicant in accordance with the provisions of this 25 Section shall be charged against any tuition waiver 26 limitation established by the Board of Higher Education. 27 (d) The Board shall prescribe such rules as are 28 necessary to implement and administer the provisions of this 29 Section. 30 Section 30. The Illinois State University Law is amended 31 by adding Section 20-92 as follows: 32 (110 ILCS 675/20-92 new) -9- LRB9112316SMdvA 1 Sec. 20-92. Volunteer firefighter tuition waiver. 2 (a) Each year, subject to State appropriation to 3 reimburse the University for the loss of tuition under this 4 Section, the Board shall offer a full tuition waiver for 5 undergraduate education at any campus under its governance to 6 (i) any person who has served as a volunteer firefighter for 7 the entire year previous to the commencement of the academic 8 year during which the tuition waiver is to be effective or 9 (ii) any member of that person's immediate family. The Northeastern Illinois University Law is 12 amended by adding Section 25-92 as follows: 13 (110 ILCS 680/25-92 new) 14 Sec. 25-92. Volunteer firefighter tuition waiver. 15 (a) Each year, subject to State appropriation to 16 reimburse the University for the loss of tuition under this 17 Section, the Board shall offer a full tuition waiver for 18 undergraduate education at any campus under its governance to 19 (i) any person who has served as a volunteer firefighter for 20 the entire year previous to the commencement of the academic 21 year during which the tuition waiver is to be effective or 22 (ii) any member of that person's immediate family. To be 23 eligible to receive a tuition waiver under this Section, (i) 24 no other member of the applicant's immediate family may 25 receive a tuition waiver under this Section, Section 7h of 26 the University of Illinois Act, Section 8h of the Southern 27 Illinois University Management Act, Section 5-92 of the 28 Chicago State University Law, Section 10-92 of the Eastern 29 Illinois University Law, Section 15-92 of the Governors State 30 University Law, Section 20-92 of the Illinois State 31 University Law, Section 30-92 of the Northern Illinois 32 University Law, or Section 35-92 of the Western Illinois -11- LRB9112316SMdvA 1 University Law for the same academic year that the 2 applicant's tuition waiver is for, unless the other member 3 served as a volunteer firefighter for the entire year 4 previous to the commencement of that academic year or is a 5 member of the immediate family of a person, other than the 6 applicant, who has served as a volunteer firefighter for the 7 entire year previous to the commencement of that academic 8 year, and (ii) the applicant must qualify for admission to 9 the University under the same admissions requirements, 10 standards, and policies that the University applies to 11 applicants for admission generally to its respective 12 undergraduate colleges and programs. 13 (b) Subject to the provisions and limitations of 14 subsection (a) of this Section, an eligible applicant who has 15 continued to maintain satisfactory academic progress toward 16 graduation may have his or her tuition waiver renewed until 17 such time as he or she has expended 4 years of undergraduate 18 tuition waiver benefits under this Section. 19 (c) No tuition waiver offered or allocated to an 20 eligible applicant in accordance with the provisions of this 21 Section shall be charged against any tuition waiver 22 limitation established by the Board of Higher Education. 23 (d) The Board shall prescribe such rules as are 24 necessary to implement and administer the provisions of this 25 Section. 26 Section 40. The Northern Illinois University Law is 27 amended by adding Section 30-92 as follows: 28 (110 ILCS 685/30-92 new) 29 Sec. 30-92. Volunteer firefighter tuition waiver. 30 (a) Each year, subject to State appropriation to 31 reimburse the University for the loss of tuition under this 32 Section, the Board shall offer a full tuition waiver for -12- LRB9112316SMdvA 1 undergraduate education at any campus under its governance to 2 (i) any person who has served as a volunteer firefighter for 3 the entire year previous to the commencement of the academic 4 year during which the tuition waiver is to be effective or 5 (ii) any member of that person's immediate family. To be 6 eligible to receive a tuition waiver under this Section, (i) 7 no other member of the applicant's immediate family may 8 receive a tuition waiver under this Section, Section 7h of 9 the University of Illinois Act, Section 8h of the Southern 10 Illinois University Management Act, Section 5-92 of the 11 Chicago State University Law, Section 10-92 of the Eastern 12 Illinois University Law, Section 15-92 of the Governors State 13 University Law, Section 20-92 of the Illinois State 14 University Law, Section 25-92 of the Northeastern Illinois 15 University Law, or Section 35-92 of the Western Illinois 16 University Law for the same academic year that the 17 applicant's tuition waiver is for, unless the other member 18 served as a volunteer firefighter for the entire year 19 previous to the commencement of that academic year or is a 20 member of the immediate family of a person, other than the 21 applicant, who has served as a volunteer firefighter for the 22 entire year previous to the commencement of that academic 23 year, and (ii) the applicant must qualify for admission to 24 the University under the same admissions requirements, 25 standards, and policies that the University applies to 26 applicants for admission generally to its respective 27 undergraduate colleges and programs. 28 (b) Subject to the provisions and limitations of 29 subsection (a) of this Section, an eligible applicant who has 30 continued to maintain satisfactory academic progress toward 31 graduation may have his or her tuition waiver renewed until 32 such time as he or she has expended 4 years of undergraduate 33 tuition waiver benefits under this Section. 34 (c) No tuition waiver offered or allocated to an -13- LRB9112316SMdvA 1 eligible applicant in accordance with the provisions of this 2 Section shall be charged against any tuition waiver 3 limitation established by the Board of Higher Education. 4 (d) The Board shall prescribe such rules as are 5 necessary to implement and administer the provisions of this 6 Section. 7 Section 45. The Western Illinois University Law is 8 amended by adding Section 35-92 as follows: 9 (110 ILCS 690/35-92 new) 10 Sec. 35-92. Volunteer firefighter tuition waiver. 11 (a) Each year, subject to State appropriation to 12 reimburse the University for the loss of tuition under this 13 Section, the Board shall offer a full tuition waiver for 14 undergraduate education at any campus under its governance to 15 (i) any person who has served as a volunteer firefighter for 16 the entire year previous to the commencement of the academic 17 year during which the tuition waiver is to be effective or 18 (ii) any member of that person's immediate family. To be 19 eligible to receive a tuition waiver under this Section, (i) 20 no other member of the applicant's immediate family may 21 receive a tuition waiver under this Section, Section 7h of 22 the University of Illinois Act, Section 8h of the Southern 23 Illinois University Management Act, Section 5-92 of the 24 Chicago State University Law, Section 10-92 of the Eastern 25 Illinois University Law, Section 15-92 of the Governors State 26 University Law, Section 20-92 of the Illinois State 27 University Law, Section 25-92 of the Northeastern Illinois 28 University Law, or Section 30-92 of the Northern Illinois 29 University Law for the same academic year that the 30 applicant's tuition waiver is for, unless the other member 31 served as a volunteer firefighter for the entire year 32 previous to the commencement of that academic year or is a -14- LRB9112316SMdvA 1 member of the immediate family of a person, other than the 2 applicant, who has served as a volunteer firefighter for the 3 entire year previous to the commencement of that academic 4 year, and (ii) the applicant must qualify for admission to 5 the University under the same admissions requirements, 6 standards, and policies that the University applies to 7 applicants for admission generally to its respective 8 undergraduate colleges and programs. 9 (b) Subject to the provisions and limitations of 10 subsection (a) of this Section, an eligible applicant who has 11 continued to maintain satisfactory academic progress toward 12 graduation may have his or her tuition waiver renewed until 13 such time as he or she has expended 4 years of undergraduate 14 tuition waiver benefits under this Section. 15 (c) No tuition waiver offered or allocated to an 16 eligible applicant in accordance with the provisions of this 17 Section shall be charged against any tuition waiver 18 limitation established by the Board of Higher Education. 19 (d) The Board shall prescribe such rules as are 20 necessary to implement and administer the provisions of this 21 Section. 22 Section 99. Effective date. This Act takes effect upon 23 becoming law.
