91_HB3468 LRB9112107ACcd 1 AN ACT to amend the Nursing Home Care Act. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Nursing Home Care Act is amended by 5 changing Section 3-202 as follows: 6 (210 ILCS 45/3-202) (from Ch. 111 1/2, par. 4153-202) 7 Sec. 3-202. The Department shall prescribe minimum 8 standards for facilities. These standards shall regulate: 9 (1) Location and construction of the facility, including 10 plumbing, heating, lighting, ventilation, and other physical 11 conditions which shall ensure the health, safety, and comfort 12 of residents and their protection from fire hazard; 13 (2) Number and qualifications of all personnel, 14 including management and nursing personnel, having 15 responsibility for any part of the care given to residents; 16 specifically, the Department shall establish staffing ratios 17 for facilities which shall specify the number of staff hours 18 per resident of care that are needed for professional nursing 19 care for various types of facilities or areas within 20 facilities; 21 (3) All sanitary conditions within the facility and its 22 surroundings, including water supply, sewage disposal, food 23 handling, and general hygiene, which shall ensure the health 24 and comfort of residents; 25 (4) Diet related to the needs of each resident based on 26 good nutritional practice and on recommendations which may be 27 made by the physicians attending the resident; 28 (5) Equipment essential to the health and welfare of the 29 residents; 30 (6) A program of habilitation and rehabilitation for 31 those residents who would benefit from such programs; -2- LRB9112107ACcd 1 (7) A program for adequate maintenance of physical plant 2 and equipment; 3 (8) Adequate accommodations, staff and services for the 4 number and types of residents for whom the facility is 5 licensed to care, including standards for temperature and 6 relative humidity within comfort zones determined by the 7 Department based upon a combination of air temperature, 8 relative humidity and air movement. Such standards shall 9 also require facility plans that provide for health and 10 comfort of residents at medical risk as determined by the 11 attending physician whenever the temperature and relative 12 humidity are outside such comfort zones established by the 13 Department;.14 (9) Development of evacuation and other appropriate 15 safety plans for use during weather, health, fire, physical 16 plant, environmental and national defense emergencies;and17 (10) Maintenance of minimum financial or other resources 18 necessary to meet the standards established under this 19 Section, and to operate and conduct the facility in 20 accordance with this Act; and.21 (11) Procedures that prevent a resident from eloping by 22 leaving the building without supervision, including 23 procedures that will alert the facility staff if there is an 24 elopement, which shall include use of equipment on all 25 exterior doors that automatically signals a patient 26 elopement. Any exterior door that is supervised during 27 certain periods of the day may have a device that disconnects 28 the signal on a part-time basis when there is direct 29 supervision of that door. If there is constant 24-hour a day 30 supervision for exterior doors that prevents elopement by a 31 patient, automatic signaling equipment is not required. 32 (Source: P.A. 83-1530.)
