1 AN ACT to amend the Illinois Insurance Code by changing
2 Section 238.1.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Insurance Code is amended by
6 changing Section 238.1 as follows:
7 (215 ILCS 5/238.1)
8 Sec. 238.1. Data exchanges; administrative liens.
9 (a) An Any insurance company doing business in the State
10 and governed by this Code shall enter into an agreement for
11 data exchanges with the Illinois Department of Public Aid for
12 the purpose of locating accounts as defined in Section 10-24
13 of the Illinois Public Aid Code of responsible relatives to
14 satisfy past-due child support owed by responsible relatives
15 under an order for support entered by a court or
16 administrative body of this or any other State on behalf of
17 resident or non-resident persons.
18 (b) Notwithstanding any provisions in this Code to the
19 contrary, an insurance company shall not be liable to any
20 person:
21 (1) for any disclosure of information to the
22 Illinois Department of Public Aid under subsection (a);
23 (2) for encumbering or surrendering any accounts as
24 defined in Section 10-24 of the Illinois Public Aid Code
25 held by such insurance company in response to a notice of
26 lien or levy issued by the Illinois Department of Public
27 Aid, or by any other state's child support enforcement
28 agency, as provided for in Section 238 of this Code; or
29 (3) for any other action taken in good faith to
30 comply with the requirements of subsection (a).
